Just wondering what the legal implications are concerning editorial images that feature children. Istockphoto states that you must have permission or consent of the parents of a child in order to use an image of that child for editorial usage. Would this simply be iStock's own personal policy or is there any legal standing in this? In other words - say you do have editorial images featuring children without the parents' consent or knowledge - could you potentially get into legal trouble?

my advice, if you intend to film something and you are not sure about laws, call the police station in that area and tell them you are a photographer and what you plan on doing and whether you need any permits or if there are any laws or ordinances you need to worry about

Thanks for the link. It confirms that images of children are okay for editorial use without the parents permission, as long as the photo is taken in public.
In my state (South Australia) there is the annual Christmas Pageant where people of all ages gather in the open street and watch. It is a televised event and there is often footage of young kids in the crowd so it must be okay here.

In todays climate I think you need to be sensitive about photographing young people but I think legally speaking there is no issue about Editorial.

Definitely. It's actually pretty rare when I photograph children. And sometimes they accidentally enter the frame when I'm photographing something else. Of course if I was ever in a scenario where I photographed a child and the parent looked pretty annoyed or upset, I would not submit that photo for stock.
