Topic: Model of Partnership Contract

Hi!

I've been doing some illustrations in a partnership with a friend and would like to make a contract to have no legal problems in the future.

What happens is that he creates the basic illustration by hand, the sketchs, and I vectorize, color, modify and put them for sale. Then, we share the earnings 50/50.

Do you have any idea how can I make that contract without going to a lawyer? Do you have a model to share? I'd like something simple, just saying he authorizes me to sell our images.

I wonder if you wrote something up and both of you signed it in front of a notary...

There is something that needs to be clear about the copyright, becaue when we upload we say we are the copyright owners.  So, unless you get the copyright in that legal document, you would not be able to upload these images to your account.  I suppose it would be wiser to have a separate account for these images, with some fantasy name of your partnership.

He can incorporate with his partner. Many examples on microstock. Iofoto for instance, or Monkeybusiness images.

Its much cheaper to go to a lawyer in drawing up the contract than afterward if things go pear shaped. The advice you'll get on a public forum about these issues is generally worth about the price you pay for it.

But then all those images have one "owner", right?  Even if it's a company/partnership.  Having just one account for your own images and your partnership images may be a problem in the future.

There is at least one prominent microstocker I know of that has two accounts on DT. It would be a harder sell if your incorporation is exclusive, and you personally are not.

^^ This is the best advice.  Do things the right way up front and you will save yourself a world of money and aggravation later.

For simple, cheap legal contracts there are often local parallegal groups you can go to and save money - check the yellow pages.  Also you could try an online legal service like Legalzoom.com.
