As you probably know our footage library is focused on high quality RED footage. We offer thousands of R3D-files, as well as HD and SD.
From now on our doors are open for cinematographers to upload video-files directly to our platform. You will receive 50% of the net price paid by the customer without concluding an exclusive contract with us. For further informations please have a look at:

http://sell.footage-online.de/

Or feel free to contact us via email: info (at) footage-online (dot) de

So have a look at your archives and convert your material to money.

Cheers
Thomas.

Do you accept footage shot on other cameras, for example Canon 5D Mk II?
I've seen some clips that are available only in HD 1080, so I would assume yes, but you keep mentioning RED everytime and that's why I am asking.
If yes, what requirements must the clips meet, e.g. which Quicktime codecs, clip duration, file size limit (if any), etc.
Your FAQ are not so specific.

Yes - footage from other cameras can be uploaded too. Here is the answer of our faqs concerning the formats:

What formats and codecs can I upload?
We currently offer the following resolutions: SD, HD 720, HD 1080 and RED. You can upload the following formats: "r3d", "mov", "mp4", "zip", "avi" "wmv", "dv", "m4v". If you want to upload RED data, please upload the complete folder with the .r3d and all proxies as one zip-file. Important: Please leave your clips (the raw material) untreated and do not convert them. If clips are too long and / or multiple scenes are in it, please let us know. We care for free to the editing, color correction, and possibly the conversion into the target format.

Our philosophy is to be personally in contact with our customers and clip producers. So don't hesitate to ask us directly under info(at)footage-online(dot)de

Cheers
Thomas.

Sorry but there's some pretty major problems with the terms of your license agreement.

Is there any reason why you don't allow contributors to cancel their licensing arrangements with you?

Quote
CLIP PRODUCER transfers to FOOTAGE ONLINE all the non-exclusive use and exploitation rights under copyright and neighboring right without content, time and geographical restrictions. The transfer of rights is to give third parties (customers) use and exploitation rights (license rights) to the MATERIAL.

(also in your FAQ: "Deleting clips in your profile is not possible.")

This clause is worded so that there is no right for contributors to remove content from your site, and basically gives you a blank cheque in terms of how you want to use the material.

Also: your "CLIP-PRODUCER earns 50% of net sales." is very different from earning 50% of the gross - so if you re-distribute through partners the commission will be substantially less.

Also:
CLIP PRODUCER expressly waives his right to be named.

Ie. you want anyone contributing to be completely anonymous.

In its current form I wouldn't touch your site with a 10-foot barge pole.

Hi Holgs,

thank you that you have read through our General Terms and Conditions / License Agreement (GTC) so thoroughly. We are at the beginning of the construction of our company, so we can always use good advice! For clarification, however, the following:

1. The contract may also be terminated by the clip-producer (see para. 10 of our GTC).
2. The transfer of rights is common in the industry. The rights are transferred, however, non-exclusive.
3. Deleting clips in the profile is not yet technically possible, but we're working on it.
4. Before we share the revenue, taxes and transaction costs are deducted (see para. 8 of our GTC). A sales through other distribution partners is not currently scheduled.
5. Our customers will use the material in their production and therefore all the footage-producers can not be named. But we are working now on naming the clip-producer while offering the footage.

We hope to have cleared up the misunderstandings. Please contact us if you have further questions.

Cheers
Thomas.

Actually I just re-read the German version of the contract - it makes a little bit more sense, unlike the English translation you have. If you're really keen on setting up this as a business, wouldn't it be a good idea to actually get these things sorted out before you invite participation from third parties (& pay someone who is actually qualified to translate your legal documents!)? As a contributor the current document still provides lots of loopholes that just don't provide protections for third party contributors.

The overall impression you give is of another under-funded start-up that hasn't really got its end sorted out, and doesn't really have the faintest idea about what is involved with running an agency.

Can I send you an HDD with the files instead of uploading those?
Could be a way easier and faster...

Yes Ian - you can. Its usefull to do that from up to 10 Gb (we mainly practice that with the bigger R3D-files from RED cameras). Otherwise I would recommand our upload-tool which is really easy to handle.

Cheers
Thomas.

this is a classic and notorious clause and should never be accepted - i know nothing about this outfit, but in computer games, eg, a popular game may end up with NO or little net after 'operating costs,' etc are entered.  and there's no way for creators to predict what may later be added. taxes are an exception since they're easily monitored and beyond the control of the producer

instead a royalty contract should always be based on gross sales, with the royalty rate adjusted accordingly
