Title: Exclusivity Question
Post by: Karen on March 13, 2011, 03:00
Are all those illustrations related to Dorling Kindersley publishers?
http://www.istockphoto.com/Dorling_Kindersley (http://www.istockphoto.com/Dorling_Kindersley)

http://www.dk.com/ (http://www.dk.com/)
http://www.dorlingkindersley-uk.co.uk/ (http://www.dorlingkindersley-uk.co.uk/)

If so, how can this illustrator be exclusive on Istockphoto?

This is part of the Agency collection that came in via Getty Images. These are marked as exclusive (with a crown) but these contributors aren't the same as those who signed up with iStock directly. No upload limits, virtually no inspection process and worst of all some of them are selling their own images RF from their own websites - Rubberball Images does that. That would get any other exclusive booted.

Getty's the big dog and they get to break all the rules they want.

Might be the big dog but fact is: the agency pics are not of the same quality, creativeness, etc, as many of the IS originals. Im actually surprised many of them even got past the editing team.

Despite assurances to the contrary, it seems they bypassed the editing team, or got through on the nod. One member has repeatedly called out really badly upsized images to no avail, (at least they were still there last time I checked).

"Yep, if us "eagle eyed" inspectors get a glimpse of an identifiable title, author, publishing house logo, or cover artwork
we will send it back for retouching, sorry. Remember that some publishing houses also have a readily identifiable "corporate style and layout"..."

Dorling Kindersley publishers http://www.dk.com/ (http://www.dk.com/) seems to have very identifiable style illustrations.
Just wandering how these illustrations can be exclusive then?

Funny handshakes.
That, and the sound of bawbees hitting the bucket.

I've done some work with DK on books in the past and if I remember rightly their standard contract has you sign away not only copyright but moral rights too, I hope that doesn't mean I'm going to see them selling off my work on the stock sites one day (but they probably could if they wanted to)

They are one of the biggest publishers of illustrated books, so they cover the whole spectrum of styles. The stuff in their IStock portfolio must be from just a couple of artists.

You mean re-selling again your work as Istockphoto "exclusive" + Agency content  ;)
Interesting if you (the original illustrator, not Dorling Kindersley publishers) are going to get anything out of these sales  ???

If they did resell (and I have no clue if they would) I'm positive I wouldn't be seeing anything from it, as they own all the rights to the images.

Hi All,

It is another avenue that will get a non exclusive in with higher sales prices and better placement. If anyone is interested in being included into the TAC collection please PM me and I can help.

Best,
Jonathan
