Dear Media Content Creators,

I would like to introduce you to Clipcentric, where we develop and license a platform for the production of local video advertising.  Our tools allow local media publishers, e.g. newspapers, TV stations, and publishers targeting local markets to quickly produce high production value video advertisements.  We strive to enable small businesses (who have traditionally been locked out from the effectiveness of video advertising due to fears of cost and complexity) to benefit from one of the most effective advertising formats.

Could you give us a rough idea of how much we would make on average if a video clip or image was used?

Ron: We are in our beta with a major newspaper company right now... getting out the bugs and adding requested features.  I anticipate our launch to be towards the end of this year, although from my experience, things can always slip.  I therefore cannot predict how much content will be used each month.  I can predict, however, that ramp up takes a while, so patience will be required and royalties will start slow.  I'll also refer to our track record, which produced very high volume.  The good news is that we have a very experienced team and a laser focus on building market share with a disruptive technology.  I hope you'll place your confidence in us.

Thanks for the answer. I am not expecting a lot of sales, but somehow I find this interesting.

When can we start submitting and when do you think our images will go live for the buyers?

Sounds interesting but I
just read through requirements for video.
No Photojpeg codec?
I think that might put off several videographers (me too) because not everybody has the footage in h.264 and reencoding a whole portfolio is not an option.

I just uploaded one clip with the Photojpeg codec.  If that isn't acceptable, I wont bother uploading video clips.  Not sure about the amount we make for video clips, a buyer would have to use a HD clip several times for me to make the same I make with the other sites I use.

Photojpeg is accepted.  Wasn't at first, but we quickly came on board.  I'll have that section of the guide updated.  Thanks!

Ron: We are currently accepting submissions.  Content will go live towards the end of this year when we launch.  Some content may be used by our beta partner, which would of course trigger royalty payment, but volume will be *slow* for months, and then start to ramp up with our sales.  Thanks for your interest!

The upload procedure need some work.  If you want a lot of content, you'll need to set up FTP and make the process the least time consuming possible.  Automatically read the title and keywords, it takes too long to copy and past all of them.  Some sites let us just upload and the rest is automated or we just have one or two clicks and hundreds of images will go to review.  That's the way to get us to upload all our portfolios.

Sharpshoot:  Thanks for the feedback.  We do accept content with embedded metadata, but this is currently read during curating.  I will push for this to be read during upload, as you suggest.  I agree this is critical and confusing to the contributor as it is.  I'll also mandate that ftp is implemented.  We've discussed this quite a bit, but it seemed sites were moving away from it.  Your comments are just what we need.

Let me know when those changes are implemented and I will start uploading. Do we need to pass a test? If so, I will go for that now. So that I can start uploading when the changes are done with meta data and FTP

Thats awefully similar to Facebook. What does that mean?

Furthermore, about taxes, do you adhere to tax treaties with other countries? Can we fill out a W-8 BEN form?

Just glanced through the contract and it looked like the only way I could terminate the agreement was if Clipcentric breached the terms.  I'd be interested in giving this a bit of a try but if they can change the terms of the contract or dump me with 30 days notice, I would like the same.

Regarding other sites "owned or maintained" by us: currently there are none, but we plan on distributing an app for our service, which would apply.  Additionally, we may require different branding for different market segments.. eg publishers, DIY small business, etc.

Regarding changes: Typically more applicable for video, we may color correct, trim, stabilize, or whatever the editors feel is required for a clip to be the best it can be and work the best for our clients.  Some content is very applicable, and we do not want to reject it based on something easily fixed by our team.

Regarding your grant to us:  We are pretty much covering all basis as to how the content may be used in order to minimize risks to us and our client... including media that has not been invented or explicitly listed.  Obviously, our clients need to feel secure that their projects comply.

CrackerClips:  We cannot force new terms on you, per section 9: "In the event that you object to the proposed amended agreement within such thirty (30) day period, then the proposed amended agreement will not apply to you."

Its too loose on the sites, and too vague, you can distribute it to a 1000 distributors if you want. As for the grants,  I dont like that at all, its way too free for you to do whatever you want.

I am not signing that contract. Sorry. Its giving you way too much control over my intellectual property. I will wait to see how this develops.

Hi pjmat - Yes, I read that but what does that really mean?  What's the process for disagreeing with contract changes?  A little vague.

I would much rather have all our work removed after giving a 30 day notice at any time and for any reason.  That keeps both parties from trying to overstep.  If Clipcentric can terminate at any time with 30 days notice it seems reasonable that the contributor should be able to as well.

To be honest,  I am not qualified to contest it atm.  I took part in those legal meetings, and I know the bullet points of what we required., but ss for the final drafting, it appeared to meet our business needs and to offer the protection we desired.  If there are terms that are simply not accepted in the industry, this was not the intent... in fact the opposite.  This, as well as the other constructive feedback is appreciated!  We will obviously not have a successful contributor program if all players do not feel like we are working together.

Workflow is weird. You should split upload from submitting/editing. I tried with few files and I going to pass until FTP is in place.

I tested a few images uploaded -- the ftp is needed asap

the upl keeps the file name as the title -- that's good in that we can sync with our archives more easily (something few agencies do), but whay require desc & tags when you read metadata later? -- make these optional

for now, I just entered 'x' for desc & tags - what happens when you process metadata? are these overwritten or appended?
