Title: Rules of uploading stock photos taken in shipyard, construction sites etc
Post by: AncientDweller on July 20, 2018, 14:30
What are the rules for photographing construction sites, gear, machines, ship interior, engine room, mechanics shops, shipyard etc...

For example photos like this randomly linked from google just to better illustrate my question:

Thanks in advance

You should have a property release authorizing you to be there.

Thank you for replay. And how about some random details... For example pipes, valves, structure etc.
Something like this random photos:

You should have a property release authorizing you to be there.

Today I was just shooting some photos from outside a boatyard, so I didn't need any authorization to be "in" there.
Could I use these images for editorial for example?

In the UK, that would be OK, provided that 'outside the boatyard' was indeed public property.
Other countries presumably have their own laws.

Hmm, yeah, I guess that might change from country to country.
I'm based in Mallorca BTW, so half British / half German 😜

The agencies set the rules for submissions and although they base those on laws - often taking the most conservative subset of laws in a handful of major countries where they license stock images - it's not a legal decision but a policy one. You need to meet their requirements, even if you think they're being too picky. They're managing their legal risk and don't want to spend profits on legal expenses.

So some agencies will ask for a property release for anything identifiable, even exteriors shot from a public place. If the setting isn't identifiable, and you remove all logos, some agencies may be willing to accept shots without a property release.

The default - which will limit your sales - is to submit them as editorial if you have no releases and can't get them. If you think the place you were interning might be interested in a license to use all the photos for free in return for signing a property release for you, it's worth asking. You'd still have to remove all logos from all equipment, but you'd probably have some useful commercial stock as a result.

a) Every agency is different.
b) That being said - 'generally' speaking if the images/videos/etc are "generic" (i.e., you could have taken a picture of a boat from 1,000+ different places) - then it is more likely to be accepted - than say something that "identifies" a specific location (i.e., "naval shipyard abc @ location xyz). Furthermore - if it is specialized technology/equipment/etc for a specific company - then yes, you may need a property release from them where they give you explicit permission to use it for re-sale, etc.
