I remember similar issues with so-called "public" art pieces in Chicago.  Commissioned by the city, for the public, paid for with tax money, installed in a public place, and then somehow the artist is able to assert that the public can't photograph it.   We're going through a period of insanity in regards to copyright and intellectual property.  

Not to mention the fact that some artists are apparently major jerks.
