Title: Panthermedia - bad news
Post by: roede-orm on July 14, 2016, 10:06
To all Panthermedia-contributors: PM pulls a portion of the revenue back. Apparently there were problems with a sale partner. Check your sales summary for 2015 and 2016!  :-\

I cancelled my account with them yesterday (because of this), they replied promptly (within 24 hours).

Be aware that the removal of your photos from Partner sites will take up to six months.

I exchanged few emails with them. It literally pisses me off. Is definitely not about $10 I lost but about business ethics and the fact they needed a year to fix it (I had 2 sales from 2015).
For me it's like saying to one of my clients - ah, my hourly rate is $10 more now and send them invoice for something I did year ago.

The dice was cast for me some month ago. But my account is still open and I can't wait, that it will cancelled finally. Hope they pay me my revenues. I see the risk that I have to send money to them afterwards.

What is the way to cancel the account?
How did you do that?

I just replied to the e-mail they sent me regarding the "adjustments" and asked for termination and removal of my photos from PM and all Partner sites. They answered - in the affirmative - within 24 hours.

I'm not with PM but I wonder if this is stated in their terms when you sign up.  I ask because if that is indeed the case, PM should provide you with a list of their partner sites so you can personally verify the images are removed. Otherwise, how would you ever know if your images were removed?

I had a case a couple of years ago where I closed an account and someone sent me a link months later of a site that was selling my underwater work.  After I inquired, sure enough it was a partner site to the one I closed months earlier.  After I contacted them, they said sorry, we will remove them promptly and they did. But the point is they kept selling. Wouldn't an API set up deactivate images instantly on partner sites? I assume each partner site has their own terms, too, which complicates the whole area of image management.

I signed up with them in 2008, I think, and I don't think there were any Partner sites at that time. Technically you're right of course, but at the rate they are selling my photos on their own as well as on the Partner sites they are welcome to have them... I didn't just say that out loud, did I?  ;D

I have just deleted my 5000 images portfolio…
Farewell Pantherrobber…

---
Edit: Just after that I have deleted all my photos I have got 10 sales for 0,23 € each (Sub sales distribution partners)… 1 has been sold 5 times… probably another error…
I will not miss them!

Following up from this if any of you have deleted images from Panther Media as I did when they changed their terms last April then go check and see if they are continuing to sell your deleted images through other agencies.

I found my images were still up for sale with one of their distributors 19 months after Panther confirmed in writing they were deleted from their own database and API distributors.

Of course they may have made sales but I'll never know as my Panther account was closed and Panther are so far not responding.

Though I know they have reacted to my email because the API distributor confirmed they had received a request from Panther to have the images deleted.

Effectively Panther Media kept any money that might have been made which is fraud as well as breach of copyright.

I have emailed them and so far they have not replied.

This is untrustworthy practice

I don't know why but I have been with three german microstock companies and I have had problem with all the three.
I have always thought about german as very serious people.
Are they?

Wow! I just checked. I closed my account more than a year ago but my portfolio is still online there. I can't log in because my account no longer exists. Sheesh. I just emailed. I wonder if they will give me any sales over the last year or just say "sorry bout that".

Effectively they have been pocketing the cash from any sales.

I wonder if the German authorities would like to know what they are doing?

Well I will be going through the TOS and my old emails thoroughly and I will see what they say. The hard part is the legalese of some of these contracts. I have little faith that I will see a dime, but we shall see. 7k + images for more than a year...

Well the API distributor definitely deleted the images Panther had put up after Panther sent them a request to do so.

But as of now there is nothing but complete silence from Panther.

It's totally unacceptable.

They partner with depositphotos. So if you have images with dp they might appear on panther as well.

Except in my case they changed the license terms and conditions and advised contributors they could end the relationship if we did not wish to accept the new contract terms.  They confirmed they would delete all images from their own and API distribution servers within one week of the end of the contract and even confirmed they had done so.

Which was not true.

Not sure what your point is. They deleted my account, completely. But the images are still online. Should they have been used for streaming I would have notified, and the content would no longer be available to other customers as per above.

Ok I'm sorted. It was a distribution partner after all. What threw me was that they used my old username with PM instead of the one with that partner. Now to contact the distribution partner..

And I apologized to them, since I was a little agitated about it. :)

I ended my account in November 2016, which resulted in a complete deletion of my account 6 months later.

By coincidence, I just noticed that some of my work (if not all) is still available on their partner site Alamy, being sold under their name. Apparently they've been cashing with my images 6 months after the cancellation? >:( I sent them an email to get some answers.

Just like Zoonar and of course the answer will be your images never sold thru Alamy ~ yeah right  ::)

Write to Alamy tell them the images are being put up for sale and they should take them down

Hello Mr. xxxxx,
thank you for making us aware of this. We regret that your images were still online by a partner, despite of on time notification. We have contacted Alamy and we will make sure, that your images will be deleted immediately.
We have reviewed sales reports and there were no sales of your images by Alamy.

kind regards

I have to take their word for it. I'll keep an eye on this though. if the images aren't removed within 3 days, I'll write to Alamy.

They've removed my images from Alamy.

I don't know what's worse: them purposefully continuing selling my content and keeping the money from sales, or them not being aware of content sold at partners. They're either unethical or very sloppy, or both.

My advice, steer clear of this agency.
