Sorry, where was the bit about the files coming from SS?  I see they linked to images downloadable on rapidshare and mediafire, but where did they brag about getting them from Shutterstock?

I found them on shutter stock, the thing about that place is you have to pay alot of money for there images. If you dont pay they have  a watermark through them. I just printed them and ignored the watermaerk while transfering the image. If you go on there and search halloween you will find the images click on one then there is a link to the artists other designs on the site you may be able to find her work some where eles online I just never looked. Hope that helps some of you out.
a post in the forum where she explains where she gets them from.........just AWFUL

I wouldn't post about this here, get in contact with SS about it.  They have taken successful legal action a few times and paid their contributors with the compensation money.

Yep I got a few el's from stolen/misused images in the past and I have no clue where or when they were used.  SS just gave me a few ELs, get in touch with them.

Stay calm and think what they will feel like when SS take legal action against them.  They aren't worth the stress, you will either get compensation if SS can do something about it or you just have to accept that some people are going to do this and get on with other things.  The worst ones are the people that have put stolen images back on the microstock sites as if they were their own.  Some people have no clue and I don't get worked up about them, their lives must be really bad if they have to resort to doing these things.

Ok thank you, your right, I have stopped looking posting and still am breathing. Really you said what my husband said yesterday, we have these philosophical conversations the what if's and how would you feel, and we talked about this very issue, your right. I get so excited by jerkwads sometimes. Some people brag about being jerkwads, there are many jerkwads. Deep breaths.

Thank you for your words I really have to take it as a complement I will repeat the mantra it was a popular piece of art someone ended up with plates, someone got tshirts but the best of all is the lady I will never know who got a tattoo. That has to be the punch line of the joke.

I would also contact the site admin at craftster with a link to the thread and a link to your images.  And let them know what the TOS from SS is or link them to the SS TOS page.

Good luck.

While it is really upsetting for you to see someone else using your images, at least it looks like they aren't using them commercially - they have just made these plates for their own enjoyment. (On many sites, no extended licence would be required as this isn't for resale - but I don't know what shutterstock's rules are)

A lot of people are simply ignorant of issues like intellectual property and think that using other people's art like this for personal use is OK. I had to give my niece a stern lecture on this as she was basing art for a year 12 project on a photo she'd "found" on the internet. Both she and her mother were totally clueless on the issues of property rights and what is appropriate and what isn't. I'd have thought the art teacher would have been cluey enough but apparently not... Certainly people on craft forums like this should be informed and educated of the issues involved - either through Shutterstock or yourself. But calmly rather than in anger, would probably be more effective And if they start producing stuff commercially or redistributing without appropriate licencing, then by all means throw the book at them.

Haha sorry to find amusement in this thread but I like the line:

"that helps out loads, thanks! i actually do the same thing lol and that site is the worst i've seen pricewise... the base subscription is 10 bucks an image! and the year long ones only let you download 25 times a day... i can do that in a minute lol"

... just imagine their reaction if they stumbled across some traditional license prices.

At least they admire your work:

Quote
While I'm not a fan of skulls and skeletons, I do love tree art and this is fabulous work.  Well done

Quote
I love trees AND skeletons! Seriously these are incredible!

Quote
so cool! i love these.

Bla bla bla. the thread is almost embarrassing.

Basically they're all gushing over your work. The fact that someone put them on plates doesn't alter the fact that its your work they like.

Its a fact of life that people who create artistic work have fans and admirers who can't or don't always pay for their work. While in an ideal world everyone would pay for your work, its not a bad thing to have casual admirers either. Maybe you should take it as a sign that you should be doing art as well as stock if you're not already.

And I'd go back and see if I can do something about the comments on that thread - they reflect badly on you.

Print out those blog comments for legal proof.  You might want/need it in the future.

The commenter is giving instructions on how she stole the images by getting rid of the watermark.

We are always finding our images being used without licenses or given away on free sites. I did not read the comments you posted, but in the future your course of action should be:
Post a polite message stating how the images are copyrighted and how they must be legally purchased for use. Ask that the user buys a proper license. Mention that by using the image without a proper license they are copyright infringing. Ask that the user remove the images immediately or further steps will be taken. And that's it.

If the images are not removed, proceed with contacting the agency handling your image and sending DMCA notices.

Trust me, I know how frustrating it is. I have found some of my best selling images being given away on free sites, and it has disgusted me so much I really wonder what the point of it all is. And the answer isn't going to trad agencies to sell RM either, because I have found many Getty Images that are stolen and given away too. In essence, right now there is no remedy for the stealing. The best you can hope for is that you have educated one or two people about copyright infringing and your image gets removed.

It is amazing when people know they are doing something wrong or illegal, yet they clearly state it in open fora and brag about doing the wrong thing. :(

My experience however so far: when confronted, people remove the images and that's it. Agencies don't do really anything for compensation. Perhaps they do if it is a corporation using the illegal material, but not an individual. Even DT, who always said we should leave these matters with them, now says we should contact the infractor directly.

Have you though of posting in that website that the images can not be used? Say it kindly, because some people may not be aware about this at all. Let them know they can not use the images just because they are online. But personal use is even more difficult to impede.

I've had Shutterstock come back and pay me an EL fee they recovered from someone as part of a settlement.  Not sure if it was a legal settlement or just something the person who misused the images agreed to do to make up for it, but it was nice to see some small compensation for improper use.

I found it hard with this one as she bragged about taking it and she knew it was from SS and she liked my work in particular she took 3 of my images, then in the middle of her praise and worship feedback someone else chimed in and said oh you don't need to take the water mark off go here and download the vector files etc. Hard to swallow the bragging and slagging me off for having the nerve to put my work online, I deserved it. When I found her site I had already found dozens of sites claiming to be the artist bragging about their talents but she was the first to brag about ripping me off providing links slagging off my work even it would be good it it wasn't stock etc.
I saw over a dozen sites who had hundreds of downloads nice of them to keep track, I found dozens of sites in other languages its viral.
I have the pill right here in my hand its a big one and I am having a hard time swallowing it.

I think if you have seen the extent of it you would be in awe, it is excessive, its like my whole portfolio is most likely on some of these sites as I imagine so is everyones. In interest of my mental health I have decided to focus on this one image when I search, that way I am not vomiting.

The stupid crafter site finally took down the blog and copies of my work, along with the many links where to find my work.  Now the thing that gets me bublin is that she got over 9000 hits on that forum topic alone.

I am sure at some point I will be able to let this go. I don't know when that is, I am beginning to feel probably not in the near future.

Renee, what a terrible experience!  Your anger is totally justified!

I tried to follow the links, but they all require joining and logging in.   Any other way to link to this person without having to join a site?  I'd like to see if I recognize any of the images she's selling.

Thank you its hard to hear let it go when its so big, that one blog told 9000 visits how to find my work on SS said my personal website sucked and then said how they could find my work on a stolen image site. It is really hard not to take that personally, and the many other bloggers that joined in to say how they too liked stealing my work. Oh its hard for me to keep it together. And I really needed empathy and you gave it to me thank you, I have been crying for days.

That little lady did not believe she did any thing wrong. She is a crafter, what she did with the plate making is not the offensive bit it is the instructing directing and bragging that causes more people to do what she did and make money. I highly doubt that she made any actual money, but here is a link on a different site where she sells her work. http://www.wists.com/soulfirsgrace

The original blog is down I asked the site owner to ban her and each member that recommended a way to steal my art and how to find free SS images. 9000 hits that is a tough one. And it seems that she is just one of thousands, just hard to swallow the nastiness.
