Title: Unfair rejection on 123RF
Post by: Beppe Grillo on March 04, 2013, 03:16
Unfair rejection on 123RF

After a big upload on 123RF I have seen most of the images rejected by 123RF for "Potential Copyright Issue"
or " Propriety Release Required"

I accept their policy, but it should be the same for everybody.
And apparently it is not like this.

They accepted that (from other photographer) without Propriety Release of Editorial License:

and the refused this

And I could continue like this for other 100+ photos.

So, in fairness (par condicio) I ask to 123RF to accept mine images, or to remove the similar images from other photographers that have no Property Release or could represent "Potential Copyright Issue"

Just forget it. The owner of any of those houses could find an american lawyer and sue everything around  it. The house used in Greek yougourt commercials or in Alpine ski huts.

Get a property release...

I wonder if the other stuff is older?  Maybe they've changed their rules slightly?
I've got images up within the same agency, half rejected for needing pty release, the other half ok. *shrug* I don't fight it unless I believe my image has best seller potential.

The owner of these houses is the Ukrainian state (I think), they are not inhabited houses, just a kind of outdoor museum

must be something in the water because I just had 4 images rejected due to the same reason- missing model/property release yet they were attached. I contacted them this morning via email to see what is up?

Then get a property release from the state.
I had to do that with Danish bridges. They had begun to reject them for trademarks, so I got a release from the state saying that the state had no copyright claim.

We arrive to the limit of absurdity…
If I make a photo to a person I need a release from this person. This is okay.
But she will wear L--- jeans and I need a release from L---
She will wear a shirt from V------- and I will need a release from V------
And the shoes are from G-----, so I need a release from G----

Oooooh!I see a piece of sock too! What brand is it? L----?
So I need a release from L----- (Hell) too :D :D

I had the same happen to me, and it drove me nuts. Several landmark images of mine where accepted as editorial while their database was full of commercial images. I reported it so many times, they wouldnt budge. I had to sign a document that would clear 123 from all liability and that I could never sue them. I asked them if all artist for similar images had signed that document. They never responded.

123 has very different treatment for each contributor. If you want to file a complaint against 123 you can email them, but I just noticed I lost 4 months of emails. So I dont have the email address.

Hi everyone,
i get very disappointed today when I see that an entire batch of 20 photos approx. was rejected ("poor lighting/composition", they said). Other agencies accepted most of the pictures.  >:(
Is anyone experiencing something similar?

I think 123rf has been fair with me.  I never experienced the unfair rejection. My last batch of 34 images was completely accepted at 123rf while BS rejected completely. The experience varies from agency to agency.
