Title: DACS payback
Post by: sgoodwin4813 on December 10, 2015, 16:51
Have you received yours yet?  I had a mysterious wire transfer into my checking account on Dec. 4th.  I just asked at the bank and it was from DACS.  Not for a lot but worth the 5 minutes it took to apply.

does this mean that you have to do searches for your work being used w/o a license or do they find these works for you?

another question - how do you find your works in books or t.v usage? i only know about using google images for a lookup and thats it

If you sell RM at Alamy, that information is given with every sale.
For RF sales via iS, I Google searched, but only found 13 (UK-published books).
No idea how I'd find out whether any of my iS pics had been used by a UK TV channel.

Did you apply yourself? I applied through Alamy. Wonder when I can receive mine.

Yes, I applied myself, to save the 50% and because I wanted to add the iS sales.

I understand it will be a bit later until the DACs shows on your Alamy sales and even more time until you get paid.
I assume you're following the relevant thread there?

Received mine this past week. I applied directly. I used the RM sales info from Alamy and then did tineye, google images and googlebooks UK searches to find a few of my Alamy RF images and sales from various micros.

Alamy sends out an email to contributors each year in summer. For some unexplained reason, I ignored it until this year. This year I got an email then at least one reminder email.
There are also threads on the Alamy forum when the email goes out with various questions.
If you didn't get the emails, and you haven't opted out from their emails, maybe you need to contact them directly so that you'll get the email next year.
(If it helps, my first email was dated 6th July, then the reminder was dated 28th.)
As above, I did it myself, as I wanted to include found iS pics in books. However, the scheme is broad-banded, so you don't need to scrape every in-use; though if you were near the next up band, you'd probably make a major effort to do so.

I received an email informing me about a potential paybacks, asking for the permission to apply for them, on my behalf:

We can help recover money owed to you

Hi xxxxx

We think we might have found an image/images of yours being used without a license.

This is what we found:
Alamy ref / Contributor Ref / Company name / PicScout Ref
.......

We haven't sold a license to this company/these companies but we think the image(s) came from Alamy as there is customer download and sales activity.

If you’ve licensed this directly or through another agency then that’s great, there’s no infringement but please let us know straight away so we can close the case.

If there isn’t a valid license in place, we’ll recover your money using specialist 3rd party company PicScout. They have a great reputation in recovering money for license infringements.

If we don’t hear back from you within two weeks, we’ll start the process with PicScout.

Yes, there were several mentions of them chasing up misuses on their forums, which surprised me as any time I've queried a misuse, they've confirmed it's a misuse and said I can pursue it if I wish (unsaid, but we won't help). Seems they will follow up unpaid uses if they think they've got a reasonable chance of getting paid, but not otherwise, which probably isn't too unreasonable. Most of the many unpaid uses I find are from the Far East.
