Anyone else having issues with them not accepting a W9 using a EIN? They are telling me that as an individual I am required to use my SSN on the w9, and the only way I can use an EIN as an individual/sole proprietor is if I have letters of incorporation.

I've never used a SSN for any of my business related tax documents, and not sure why they are requiring it all of a sudden now after processing previous payments under the EIN.

I believe that only applies to immigrants or other individuals who are not able to apply for a social security number. I do have an SSN, but I do not give that out and instead use my EIN for any business related stuff. I also use it on any tax returns as well.

But it seems the only way Depositphotos will allow me to use the EIN as an individual is if I provide letters of incorporation.... but you have to be incorporated to have letters of incorporation at which point you are no longer an individual?

You're right they're wrong. We'd all have to be incorporated according to them.

Good Luck, here's the way I see it: (from a website about what is an EIN)

You need an EIN if you have employees, operate as corporations or partnerships, file certain tax returns, or withhold taxes from income other than wages. Business entities must apply for an EIN by phone, online, fax, or mail before they can begin operations. All forms of businesses can apply for and be issued EINs, including:

    Limited liability companies (LLCs)
    Sole proprietorships
    Non-profit organizations (NPOs)
    Government agencies
    S corporations
    Partnerships
    Estates
    Trusts4

The IRS is not biased toward the size of the company. This means even those with only one employee are just as eligible for an EIN as multinational corporations.



You have one employee and it is you. Maybe I'm wrong, but this has to do with YOU withholding taxes. But at the same time, you don't have to be a corporation to use the EIN for tax purposes. Sole proprietorships

This is why I pay an accountant. Even simple things like forms and licenses can be oddly defined.

I am a little confused about this and I am also interested in all this issues because I am trying to incorporate a LLC as non resident in US (not related to MicroStock).

So, you are trying to sell images by using your company?? Or they became crazy and are asking you to fill taxes papers as company??
