Title: New Terms of Use
Post by: Lina on September 21, 2022, 03:40
Contributors Agreement: https://wwwimages2.adobe.com/content/dam/cc/en/legal/servicetou/Adobe_Stock_Contributor_Agreement_Addl_Terms_en_US_20220415.pdf (https://wwwimages2.adobe.com/content/dam/cc/en/legal/servicetou/Adobe_Stock_Contributor_Agreement_Addl_Terms_en_US_20220415.pdf)

Adobe General Terms, including terms for contributors (if previous link doesn't seem trustworthy): https://www.adobe.com/legal/terms.html (https://www.adobe.com/legal/terms.html)

Sounds too familiar and exciting... I have feeling we can expect lower pricing and earnings soon.  :-\ Well, I don't remember old TOS, maybe some of these terms were there too. If someone notices something else interesting, please comment. These terms caught my eye:

"We may modify the Pricing and Payment Details from time to time, including but not limited to updating the categories of Works, updating pricing and payment terms, and directing you to new Pricing and Payment Details for pricing and payment information. You should look at the Pricing and Payment Details regularly. By continuing to submit or upload Works or by not removing Works, you are agreeing to any new Pricing and Payment Details as revised from time to time."

"You may remove any Work from the Website at any time, provided, however, that you do not remove more than 100 items of Work or 10% of the Work, whichever is greater, in any 90-day period without 90 days' prior written notice to Adobe. "

I do not know whether the removal rule is new, but the "we may modify pricing & payment"-thing is part of every agency's contributor agreement I know of and I am sure it has been there before.

And I believe that Standard and Extended license terms for customers are changed too. I am pretty sure selling on merchandise wasn't allowed at all with Standard license and with Extended license was allowed, but only if our work was modified. Now it basically says it is allowed with Standard license if assets are modified and with Extended license without restrictions.

Another "exciting news".

I'm starting to think that in the future "pay to list" will be a "feature".

The contributor specific agreement was last updated in March 2022, effective April 15, 2022, so we've been living with these terms for 5 months already.

The kitchen sink general terms contain a mind-numbing array of details about whether you're a business user or individual and thus whether "you" means the company or a person. It's possible some of those changes might have an impact on contributors, but I think it's much more general for Adobe's customers, not us as suppliers.
