Title: Can they resale my photo as postcards
Post by: DeuS.Mikelle on September 09, 2014, 17:09
Hello and sorry to bother you,
I just saw my picture on some website who is selling post cards for 0.39€ per one.

I don't know if I'm wrong, and what can I do about it, I just know that I never sold enhanced licence for that photo and as I know, noone can use your work for resale ?

Thanks in advance !

You would need to know what site sold it and what their T&C are.
As it might be difficult to find where they got it, read the T&C of all the sites you submit to and see what they say. Usually an EL would be needed for this sort of use, but some partners etc have different arrangements.

Yes, everything is possible in the game of MS

That use needs a special licence from SS.
So if you haven't sold it anywhere else, you need to find out whether they bought it from SS (who don't make it easy to find out when you need an enhanced licence, you have to go right down the small print at the bottom of the page and click on Stock Photo Licensing Terms, than wade through a long, long string of verbiage) or maybe lifted if from one of the legal uses.

Someone else may advise you on how helpful SS is in this sort of instance. If you have only sold the file from SS, that should make it easier - in theory at least - to chase up.

Good luck!

Thank you for everything ! I guess the best ways to deal with this is to forget about it :-D and for now on, don't look on the internet for your images :-D

I'd contact SS to see what they say; I'm not with them so don't know how good they are at this, but it must be worth a try.
Or contact the company, pleasantly in the first instance, and ask from where they bought the image. It could be a 'genuine mistake', given that SS don't make it easy to know what you need an EL for - looking at the file page, it seems to be only if you want a Tiff.

It could be a Fotolia partner. They have an API that lets their partners access the full FT database, so your image showing up on the website would not mean that it was bought before. Once they sell a postcard you will receive a sale.
Don't know how they could possibly make a profit at €0,39 per postcard though...

Have you checked this  (http://www.microstockgroup.com/general-stock-discussion/a-list-of-partner-programs/)thread if the website is a known partner of any agency?
