The company is requiring users to agree to the new terms in order to continue using their Adobe apps, locking them out until they do so …

Adobe says that its new terms “clarify that we may access your content through both automated and manual methods, such as for content review.”

WHAT IS THIS ALL ABOUT?

Maybe the AI training well that is Adobe Stock is not running fast enough for their AI training needs. Using every Adobe user's content to train firefly would fall under the umbrella of "improving the Services and Software".

One of the reasons I am not a big fan of the subscription software model where terms can be updated at any time with no recourse but to leave.

Or maybe it is some completely innocent thing that is incredibly poorly worded and announced.

I don't know which products produce the "new terms" dialog shown in this article - I just restarted Photoshop and did not get any dialog about new terms.

The wording about content being uploaded suggests it might be related to things like Creative Cloud Express where work is done online - and I don't use any online portion of Adobe's services. All files and edits are done locally.

It's a shame that Canva bought Affinity :)

The occupants of the C-suite at Adobe don't seem to have a clue about the world most of their users live, work and operate in. They're busy chasing AI glory and a boost in the stock price.

I did follow the advice at the end of the article to turn off the permission for Adobe to analyze my content (which I don't remember turning on so it must have been on by default). They have a FAQ page about what this sharing is should you wish to read more

A series of posts on another forum I'm on explains that this has been completely blown out of proportion. Nothing has changed with the terms - Adobe made the mistake of saying the quiet parts out loud when attempting to update verbiage. Section 4.1 deals directly with Cloud services.

“(1) any modern cloud service has legal screening requirements like child exploitation imagery - the TOS ability to review is legally required for those who host content.
(2) the license required “solely for the purpose of operating…” is required to do basic things for customers, like making thumbnails, open a file on the Photoshop web app, index for search, etc. and when we support third-party integrations for workflows, that requires a sublicense.
(3) we have always used ML to improve masking, selection and other basic tools, but explicitly don’t train Firefly GenAI on customer content, it is trained on a licensed dataset with a customer compensation program that is well documented.”

“But I agree the summary wording is unclear and I’ve given that feedback to legal. the actual TOS are similar to any other modern software provider with cloud features that requires the service be able to ‘access’ a file — like when a user wants to open it on Photoshop web app, needs files indexed for search purposes, chooses to share a document for review online with a colleague, auto-tagging in Lightroom, or other cloud-enabled capabilities. And many of these capabilities technically require a license ‘solely for the purpose of operating’ as stated. Adobe has had something like this in TOS for over a decade."

it's nowhere near as dire as you imply--

They go on to specify that this review is for CSAM, as well as app usage which breaks the company’s terms of use – such as for spamming, or hosting adult content outside of the area designated for this.

it appears to apply to content you supply to adobe -

Whatever Adobe does, let them do it.  They throw more than enough bone back.   If there was an option to be Adobe exclusive, I'd happily ditch all other 10 cent / 15% agencies.

and what's wrong with that? it's boilerplate ToS (always fine print). if you don't agree they won't se it - isn't that solving the complaints that AI training doesn't ask their permission?

- some go much further, such as many contests which state when you submit you are giving them license to use your image in any way they wish.

After Effects, Media Encoder, and Premiere now require a login to open. They close by themselves every 20 minutes or so, and you need to log in every time you reopen them. It's incredibly frustrating!

Save frustration and your money.
Use Da Vinci for edit. Hitfilm and blender for effects or 2d animations. Unreal engine (like blender) good option for 3d animations.
All mentioned are free and very good. ;)

I'm not outraged and headlines or Subjects that lead with an emotional opinion are divisive.

If clarifying the TOS is creating an issue, some people have nothing better to do than find things wrong or be grumpy.

Yes, the contests are more often than not a scam anyway. Paid jury, entering and paying, gives them unlimited rights. Nothing but paying to give away our work, and rights, which is worse than low pay.
