Title: did I need a modle release?
Post by: davidagall on October 30, 2009, 17:44
The other day I was in a hobby store and came across some miniatures.  I have seen pictures of them used in microstock and in art photos and thought they would be fun to shoot.  I took a few shots and they have been accepted.  After uploading them I started wondering if the miniatures I used could have a copyright issue?  Before I upload anything else, do you think this will be a problem?  I hate to delete photos that have made it pass screaning at istock and the others.

Here are the photos in question

Thank you for your help
David

I think that if anything, you would need a PROPERTY release from the manufacturer of the miniatures. However if you haven't had any trouble and have had images accepted, keep shooting and uploading them!

iStock seems to be the strictest site.  You can upload them there and see what they say.  If they accept them, you should be OK

 Hi David,

I would think unless they are very specific in their nature than no you don't need a release. The creator has to be able to prove they are absolutely theirs, like if they were Disney characters then you would have an issue. If they are just standard miniatures that many factories make then I would not worry about it.

Best,
Jonathan
