Title: European Parliament Copyright Directive
Post by: Justanotherphotographer on June 22, 2018, 03:14
Very important petitions for any creatives to get behind.

The second is Getty's, it always makes me gag a little when they pretend to give a * about our rights, but my enemy's enemy and all that.

Sorry - to be sure: here "framing" is the same as "hot-linking"?

If I have the meaning correct for hotlinking, yes. It is pulling an image from another site without permission:
"What is framing?
Framing photos is a way of using images online without asking the permission of the person who owns the copyright in the photo –known as the ‘framing loophole’.
...
A ‘framed’ photo works in the same way – a website can use an image hosted on another webpage without having to copy or upload it, instead the image is pulled through from the original page and text is framed around it.

Isn’t that copyright infringement?
Unfortunately, not right now. In the Bestwater case, the European Court of Justice (ECJ) established that if an image is available online once, and no technical protection measures (like paywalls) are applied, framing the image onto a webpage doesn’t need the copyright owner’s permission.
"

I gather there is also another petition against it. Along the lines of
the cost for companies to implement automated tools to ensure compliance will be huge
so only big ones will be able to comply and will therefore control the market
and there is a risk that everything will ultimately be watched online.....
though I thought the latter happened anyway! (Just try saying something even a tad controversial and watch the reaction...!)
:(
Be nice if people didn't just NICK stuff!!!!!!

I assumed you'd done that years ago with your profile pic ;-). Don't we all sell our souls when we sign up to our first microstock agency?

Weird then that it is all the tech giant lobbying against it. I am sure they are just doing it out of the kindness of their hearts to help preserve their smaller competitor's platforms...

Seriously though, all the organisations I know that have history of actually fighting for creatives, not for profits etc. are for it. The other side just reeks of a disinformation campaign to muddy the waters.

The downfall of memes.

These would fall into "exceptions to copyright such as parody, quotation, criticism... Safeguards are already built in to the proposed text of Article 13, therefore the production and dissemination of ... content, including any derivative content, will not be adversely affected by these new rules, as some have suggested." (Quote from Getty, I know but in this case they are correct and I would only be paraphrasing so just copied and pasted)

Interesting, many opposed the new rule are pointed exactly meme-styled works as a reason to deny this rule. I hope Getty isn't deceiving all of us. :) (i wouldn't be surprised)
