I got the following message today through my facebook account and need some advice from the experienced folk on MSG:

We found your photo ID 9713761 on Shutterstock, and we are very interested to buy it for our client for an TV commercial in Croatia, but only for us, like no one can use it in the world except us
for a year? And of curse, we would like to know how much it will cost us
in that case..

The image is nothing special however it has been for sale an multiple sites for nearly a year:

If it has been for sale for a year then you should be able to remove it then from BS and others?

I'd look into it, I would expect that you should make more on this image than you would on micro in the 12 months restriction period.   

They appear to be quite a legit enterprize, look at their key accounts page.

If it's been sold before under a RF licence you can't give them what they want - that nobody else can use that image within the next year.
Anyone having bought it before might use it.
If they accept that restriction, than go for it. No idea about the right price though, but don't go too low, if they go through the effort of contacting you personally than they probably do not care about a few dollars...

I sent them a note explaining that it has sold many times over the last year and I couldn't guarantee that it won't be used for a project later this year. Also, it may take several months to disappear off affiliated websites such as Photos.com through StockXpert.

I am surprised that they tracked me down using my name and found and contacted me on Facebook for what I consider a very un-unique image??

Which is why I am a bit suspicious  ;)

if he wants an exclusive rate, better it give it to him.  but you also gotta ask if the images was downloaded by anyone previous to this request...because if it has, then your out of luck.

usually, since it is a SS image, i would think they would contact you via SS.
however, if the contact infos, .........

are not readily available on their site, then i suppose you can say it is likely to be real. of course, you could try writing them at their official site to ask them if it was really them who wrote you.
i wish you all the best, and that the offer is not a facebook prank.

It is marketing agency owned by biggest regional food company Agrokor aka Konzum. For them, priority is that you don't sell that image in future so that their competitors can't have the same image, and that is all. I am from croatia, and I think you should take a chance and make an offer. If they accept than remove your picture from stock agencies but make a notice to them that image has sold before as RF and that all.

EDIT: Yes, infos are correct. Name, Company, adress and your image will be probably use for Konzum (www.konzum.hr). Don't be to cheap when you send your offer. If they want to shoot such picture expenses will be around 400-500$.

To give you an idea for price, you could go to alamy and click on a rights managed image and then price out what the cost of it would be for one year world wide exclusive.

tan510jomast, I hope this isn't a facebook prank, but it seems unlikely they would go to the effort of finding the owner of an image on SS probably through Google and then constructing an email of interest. Hopefully  ;)

Leaf - going through Alamy the price came out at $2,200 which I think is a little high because it would be cheaper to hire someone to take and edit such a simple shot.

As long as they are happy with the fact that it may pop up somewhere because of an old sale, but I think dbajurin makes a really good point about restricting use by competitors.

I guess they are taking this direct approach to avoid the 'middle man' expenses and getting an far cheaper than going through a RM agency. I was thinking about $400 max to remove this image from all sites and give them exclusivity for 12 months.

If I were you, I would screw them up. Sold image for big money, with promise that I will remove it from microstock, and when I get the money, I would continue to sell it, what can they do? Just dont sign any agreement. LOL!

Stu, so far it looks legit. so i am glad for you.
and since it removes the middle man, you could ask for 50% less. and still get something worthwhile.

As it would be easy to reshoot I would offer a "new and better version" that hasn't been sold RF yet.

And you could write the cost of the steak off on your tax and enjoy a nice dinner.

I am also from Croatia...

I think also that  is "Agrokor company" or some of their daughter companies...

You should listen dbajurin's advice...

That is the biggest food company in this part of Europe...

Very honest in the businees...

If you have open account on DT,you could give them link where they can buy this picture with SR-EL right, then delete this picture from other sites...
