Photographer suing Skechers, a shoe company of whom I have never heard (maybe they think 'all publicity is good publicity) for an outrageous (IMO) amount for using images in ways beyond the contractual agreement.

Skecher's first line of defence, which has already been thrown out by the court, was claiming that they assumed control of the copyright through alterations they performed on the images from slight modifications in models skin tone to the substitution of models body parts and the addition of substantial graphic effects.

Sketchers are popular shoes here in the US.  I own a pair.  Guess I won't be buying another.

Their attorneys need to go back and re-read copyright law. Good for the judge who denied the motion. Maybe if this photog gets awarded the $250 million, it will serve as a warning to other copyright violators. $250 million seems excessive, but money talks.

I own a couple of pairs of Skechers. They are a good shoe. But I can only afford them when I find them on sale somewhere. After this shenanigan, I won't be buying any more.
