Title: Is this allowed?

So this person has my cartoon sun image, very small, in this website:

http://www.43things.com/person/justbreathe444/photos

There is apparently no watermark, but this is an image in which watermarks don't waork well (especially LuckyOliver - this is the image used in some websites with LO watermark). 

Anyway, even if the person purchased this image, what is it doing here? By seeing it there, I would expect it was the person's own work, what by no TOS can be done. It would be ok if it was illustrating a blog entry, for instance, but it doesn't seem right that is listed under someone's photos.

It looks like this member used your image as his avatar.

So I guess it should be ok.

It reminds me of one of my photo used in a template for  a photographer's site.  The company who did these templates (and selling them) used my photo (and others) on a faked site, something like John Smith Photo to illustrate their templates; imagine my reaction when I found it!

But navigating throught the site I realized what it was, and I know that TOS on many sites allow use of photos in templates, programs, etc...
