Title: Olimpic Rings Editorial?
Post by: oboy on October 12, 2009, 16:31
Looks like I wasted some time creating some images with the Olympic Rings. They were rejected. Though that they were a flag and therefore ok, but ...

Now found this topic that explains it. http://www.microstockgroup.com/newby-discussion/image-themes/ (http://www.microstockgroup.com/newby-discussion/image-themes/)

Now comes the question: Can they be submitted as editorials?

I would very much doubt it as presumably they are the actual subject of the image rather than something in the background.

Not sure you can have 'editorial' illustrations anyway __ kind of an oxymoron.

The Amateur Sports Act, 36 U.S.C. 380, gives the International Olympic Committee the exclusive right to prevent any person from using the following items for the purpose of trade, to induce the sale of any goods or services, or to promote any theatrical exhibition, athletic performance, or competition:

The symbol of the IOC consisting of five interlocking rings

    The emblem of the corporation

Any trademark, trade name, sign, symbol, or insignia falsely representing association with, or authorization by, the IOC

The words Olympic, Olympiad, Citius Altius Fortius, or any combination or simulation thereof tending to cause confusion, to cause mistake, to deceive, or to falsely suggest a connection with the corporation of any Olympic activity.

I believe there is no conflict.  Editorial is not necessarily newswhorthy, and you can have illustrations in a magazine article.

There are a lot of comic strips that use the rings.  It seems they are considered also editorial.

Strictly editorial is fine.  You might want to try and submit to one of the traditional RM/Editorial agencies in your area as the micros seem a bit paranoid (read: ignorant) when it comes to these things.  Doubt you'll get them across the line.

Good luck.  JC
