Just had a call at home from a Chicago Ad Agency wanting to know if I had a "Talent Release" for the two people in the distant canoe.  I don't even know those people and who would know who they are?

The image is with ShutterStock and NO release was required by them.  I guess Ad Agencies really do put strict requirements on microstock "model release?"   :(

Guess I'll stick to birds.   :P

im pretty sure istock would have rejected that pic without the MR for those people in the background. If you can recognize yourself from that photo then you would need a release.

So what if you're into archaeology and you get your image rejected for artifacts, how do you know if it's because of the content or the pixel problems?

It's a gorgeous picture Warren.  If you can't get releases from the boaters, maybe you can set up something similar and shoot it for stock.  I really like it!

Was that a national forest location or private land? A private lake or river? Did someone design the shape of that boat? And what about the oar, life preserver or clothing design? All kinds of problems with this one.

Yep. Best stick to birds. Wait a minute! What if that bird was once owned by someone and it got free. Best find out who the owner was and get a property release.

Lithic debris is not protected unless it's found at a grave site. ;)

Just write the MR urself, smudge the writing a little and say it fell in the lake  ;). Great photo Warren, apart from the artifacts of course.

They are only a pain because Micro have turned it into a pain, supplying releases to RM is as easy as pie.

Just take a risk management approach. What is the probability of someone recognizing the picture - negligible. What is the probability they could take offense -negligible. What is the risk they would sue -negligible. What outcome could they achieve if successful - very little.  Therefore on all counts the risk is almost nonexistent - time to be creative.

This whole business of MR is getting to the stupid stage.

Thanks for the kind words and for the humor.  I did enjoy both.
As for the point ... I was suggesting that it is the BUYERS that insist on releases.  Our agents (microstock sites) are just following instructions. 
@Lisa ... My stuff is usually just "catch it if it happens."  I very seldom do setups.  This was on one our adventures ... canoeing in Maine.   It would be fun to go back and do it again and hope for the perfect time of year, perfect time of day with the perfect light at the just right moment.  Henri Cartier Bresson?   ;D

PS: Is it worth forging a release for microstock prices?   :P
PPS:  I forgot to count my food setups.  But those are only if I am going to eat it.   ;D ;D

 If you are done with people come be on the other side of the fence at Spaces Images. One of the reasons I built the agency was so I didn't have to chase models with A.D.D. around anymore. Just me and my camera alone at last : )

I would have to go back to Peru to get model releases :-) Wait, some of the people were tourist from all over the world :-(

Thanks, Jonathan:  I'm still shooting family pics.  I have appropriate releases for them  The query was about the two people in the distant canoe.  SS did not require me to have a release.  That is why I was surprised when the agency asked for one.

As for your agency: Thanks for the invite.  I had never considered my port worthy of submission.  Maybe I should have a look?   ??? :-\

@melastmohican:  Wow... great shot.  My wife and I are very envious of that adventure.  I'm afraid we may have gotten too old to realize our dream of doing what you did.  Is it very strenuous?

My image didn't need to be editorial, melast.  It is my best seller at shutterstock without the need for releases.  Very surprising that the ad agency needed the release???

they refer to it as "talent release."  Was it the same for you?

I'm relieved that someone else got the call.  I had started to worry that it might be some type of scam.   Getting paranoid in my old age.   :P

Nope. I've actually got two emails from different employees. One wrote model release and another - talent release.

My trip to Peru was organized by local travel agency and it consist of two parts: 4 days in rainforest location and 4 days trek on Inca Trail to Machu Picchu. Second part would require walking on high elevations so it might not be for everybody but I have seen 60 year old people doing it. If you have more time you can spent some time at Cuzco to acclimatize so the walk is not so hard. One of my friend who is 60, went to Mt Everest base camp (much higher than Inca Trail) but he was riding a train from China to get slowly used to altitude.

Aging seemed to happen overnight, melastmohican.  I'm 72.  I ran a marathon at 62.  Won a motocross race (the over 40 age group) at 65.  Then ... got old.  Maybe it was retirement?   But, we still love going and seeing.  Just have to avoid the long hikes and steep climbs.

My wife is our travel planner/organizer.  Peru is still a possibility...maybe.   ??? ;D
