They are stealing money already earned (cutting it by 50%).
So not only cutting earnings of new sales but cutting MONEY ALREADY EARNED!

Is this legal?

I have always had all kind of problems with german companies, always!

They are stealing money already earned (cutting it by 50%).

Is this legal?

I wrote them to ask if I have understood well, and if it is legal to cut already earned money.
Let's see what they will answer, if they will answer

There are no worker's rights in this business. Agencies don't pay, agencies cut earnings, agencies don't report sales and there's nothing we can do, take it or leave it. The sad part is that the same agencies present themselves as politically correct on all aspects except respecting the people that work for them.

You cant just randomly cut what you owe people unless youre going through bankruptcy or other proceedings.

You cant just randomly cut what you owe people unless youre going through bankruptcy or other proceedings.

Sure you can - but then they can refuse to supply you, sue you or take other action. It's like a company stretching out paying their bills to 60 or 90 days instead of 30 - they just say they're doing it and don't need anyone's approval to give it a whirl.

I could never find anything of mine Photocase liked, so I didn't get this communication, but perhaps they are asking for people to voluntarily forego royalties to keep the company in business? There have been cases where companies and employees worked out deals outside of bankruptcy proceedings, trying to keep a company going, but typically there was some quid pro quo. What is Photocase offering to contributors, if anything?

And with a bankruptcy, there's always the risk that you'll get less than they're currently offering - I think contributors are unsecured creditors with no special priority over others owed money by Photocase.

Given that I never heard stories that they were a great earner for anyone, why would contributors have any stake in them staying in business?

That was my immediate thought as well. Nothing lost and everything owed, is gained.

Maybe with more of these after the fact cuts, or closings, which is the future, people will stop supporting these parasite agencies for the measly money?

One point in their favour.
Although I don't like them too much and I find the way they behave inadmissible, I must admit that with only 150 photos on this site I earned more than with Dreamstime + Bigstock + Canstock + Zoonar + Picfair + 123RF + Depositphotos + etc. combined, sites where I have between 5000 and 7000 images

After sending an email to demand my earnings, they obliged, paid in full and shut down my account.

On their forums the new CEO says their goal is to transform Photocase into a European Stocksy.

Ok then, lets see how that works out...

Lol

I just posted for the sake of anyone that wants to take their earnings and run.
They will rebook the earnings you have already made prior to the claw backs. You just need to send them an email requesting such.
