Title: Seeking advice. Products sold via Groupon with my artwork.
Post by: daveh900 on December 19, 2013, 01:38
Hello all!

Just stumbled across a Groupon offer (expired) that sold products featuring my artwork. These files have never sold with an EL license nor do I knowingly sell these designs anywhere that allows this usage.

What would you do?

Thanks!

These are good sold by Groupon so you will have to take screenshots, download the web page into pdf and then contact groupon.

Do you have these images at FAA or any other website that sells art? Maybe groupon would take order from customers and once they know the number of orders they would buy from these websites and post it.

I have grabbed screenshots of everything and found the vendor that offered these through Groupon.

I do not sell via FAA, and I'm nearly certain these were all purchased via a subscription plan at ShutterStock.

The product now has "No Longer Available" beside it where a Purchase icon would normally be found.

Here is another that is active (of course I have no idea if they purchased an EL on these).  Shows 190 purchased:

You need to go after that vendor - It's says over 70 sold. At the very least you get an EL for each different design sold. Good luck, hope you figure out where they got them, that would be a starting point.

Unfortunately with partner programs, many people will never know who sold what, to whom, for how much. Total loss of control and rights.

Go after the vendor, not Groupon, but if there's a legal action, include Groupon for handling them. I suppose the current examples above, the image owner could notify Groupon that the product is being produced illegally! Shut them down.

A few photos of my friend's wedding photos appear in Groupon in similar manner. She didn't sign model release and her photos were shot by a top wedding photographer in my city. I asked her to contact her photographer and I heard he was mad and get his lawyer to contact Groupon. Not sure how it goes from there.
