If you use this program in Adobe Photoshop (See link below) and the sky image you selected isn't your own image wouldn't this be against the Microstock rules?

Nothing is more easy than shooting your own beautiful skies.... and it can be done mostly everywhere.
I fully agree! Shoot your own skies and use those images for your future sky replacement needs with stock content. It's both easy and effective! Plus, it's kind of fun
In my personal portfolio, I have found that images with a sky that pops, are more likely to sell (this is a personal observation, not based on official Adobe stats or recommendation). If for whatever reason, you don't expose for the both the sky and your subject the way you want, I believe it's worth the extra effort to add in an appropriate replacement sky.
