saw this on the twitter last nite:

"shutterstock, fotolio, istock and others have a huge competitor coming in vettaimages.com.  were [sic] launching mobile and internet national adds [sic]"

anyone hear about this?  I wonder how well iStock will take this use of the term "vetta" -- do you think they have that copyrighted?

also.. I hope they use better grammar (spelling) when they do run their advertisements (or "adds"). :)

I don't think they are associated with istock -- if they were they would use better grammar like "we're" for "we are" instead of "were."  bad grammar just looks so amateurish to me.  If you want something to come across as professional, at least use the proper spelling and punctuation.

another tweet from them says that they are also using bellaimages.co --  I saw that and immediately thought of Todd and Renee Keith who have BellaOra Studios http://www.bellaora.com -- but i guess there are already a lot of photographers and studios using the word "bella" out there besides them.

Do they? Vetta has also been a brand of cycling gear since the 80's;

Vetta is also a hiking shoe, a model of settee and countless other things ... as well as being an Italian noun. I think Istock would struggle to claim ownership of the word wouldn't they? They've clearly just jumped on the same bandwagon as everyone else in their use of the word as a 'brand'.

Vetta has been a well known guitar amp for several years, produced by Line 6.  I have a smaller version.  It has been around much longer than iStock's program, and it is trademarked by Line 6.

  Trademarks are specific to an industry. The test is whether a consumer would be confused by the trademark. For instance, there is a bicycle company with a vetta trademark for a handlebar design. Vetta is clearly trademarked on the istock website, so this new company either doesn't have a clue, or is a part of getty, which seems unlikely. No one can get a vetta trademark for photography now that getty has it, and is clearly using it in that industry.

The Twitter post was unprofessional and suggested to me it was just a few contributors putting up an indie site.  If it was a legit company, then they need a better marketing program.  Either way that name is never going to fly.

I'm thinking of starting a site called iBigCanDreamstime.

That's true. Usually you use the tm while the application is being processed, which can take more than a year. I had something trademarked and it took so long I forgot about it, but one day it came through. Out of curiosity, I went to the trademark website http://www.uspto.gov/  and looked up vetta. Getty has a pending application which is actually in suspension now, awaiting a reply for technical reasons. It seems to have something to do with the apparent lack of a Canadian trademark in the application, due to the application being from a canadian company. ( at least thats' what I got from a quick look at the application. ) Wouldn't it be funny if istock loses the trademark because they never answered the email from the USPTO? ;D  Another epic fail?

well, I had responded via tweet to the original tweet with this:

@vettaimages so istock doesnt have a copyright on the term "vetta" or are you associated with @istock?

they didn't respond to me but @iStock (the guy who runs the iStock twitter account) replied to me with this tweet:

@JamiRae Yes, we do.  No, he isn't

so I guess it's a bunch of dreamers that will soon be either changing their name or abandoning the whole idea.  :)

Well the Tweeter is probably just a Lobo type employee who is hired to do nothing but Tweet/Post all day, but probably has little to no understanding of the company's actual trademarks.  So it seems we have two entities who could use a lesson in trademark vs copyright - the VettaImages.com dreamers, and the Tweeter.

Poor choice of names legally or otherwise. They should create their own identity of they have any Uova.
