This person is allowing downloads of stock images from his website. Better check, one of yours might be there.

I am sending a copyright infringement notice to flickr now for the ear of corn on the first page. Your photo might also be distributed illegally. He states that you can download a large size image, but when you check in PS, it is not a large size...just resampled. Mine is 3x3 at 300dpi. Another I checked is 14x9 at 72dpi.

sorry it involves one of your own.

it looks like there are a couple of batches of a certain photographers, since many of the photos look rather similar . i wonder if those are the dude's own.

or perharps the dude (or duda) bought it  with a sub and thought, "yea... ROYALTY FREE!!!"

I notified istock and the individual artists whose images I found on istock (some exclusive...)

It didn't make sense to me either for someone to offer downloads free of charge, but here is one scenario I came up with.

I round up 10 designer friends that use micro. I go buy an image and we all split the cost 10 ways. Then I post it on my flickr site so my buds can go download it. Makes perfect sense to me. What might cost $10.00 for each person now costs $1.00.

I am really getting annoyed with this flickr.

I am finding these by using Tineye and googling my own name. I hope everyone here does the same so we can TRY to keep on top of this. I wish the flickr site would punish more severely and notify its members that this is forbidden.

Wow this guy has a bunch of images. He's proubably adding daily. That's the same ear of corn you had problems with before. Wonder if this was where the other person got the photo for his alteration or is it the same person? Do you know?

I also notice on the right hand side of the contributors page there is an Additional Information section. Under that is a link More Properties. If you click that, all of my metadata from the photo shows. Including my copyright. But they are still infringing on copyright by allowing others to download the image.

From the istock legal terms:

Permitted uses, section 3.(c).3:  online or electronic publications, including web pages to a maximum of 800 x 600 pixels for image or illustration Content or to a maximum of 640x480 for video Content;


He will be removed from there shortly, I'm sure.  Although it's likely he's selling or distributing through several other venues.

This scenario doesn't make sense. He can better distribute it by email or put it at a closed website with registration. Many of those around. What we see here is just the top of the iceberg I guess. Actually, if we ever need a microstocker's guild, it's to address these kinds of issues. We could deal with Flickr in a more organized and powerful way then.

I already had a case similar and flickr/yahoo was very prompt in getting the image removed. I just would like to see some sort of punishment by yahoo used to enforce the laws.

Good catch Cathy.  None of these are mine, but I have had this problem with Flikr in the past.  They are always pretty quick to remove them, but as you say, there should be some more severe punishment.

I just got an email back from yahoo saying the appropriate action has been taken. When I go to the page I provided a link for above, it says This Photo is Private. Oops You Don't Have Permission to View This Photo. To me, that means he has just added a password protect so I can't see it. The image is likely STILL up and STILL being offered for download to whoever he gives a password to.

I replied to yahoo saying the above, and saying they did not take the appropriate action. The photo needs to not be offered for download and I would like proof that that has happened.

Could I ask a favor... can someone go check that link again and see what it says for you? Would appreciate it. Thanks.

I saw a message about this on istock's help forum a little bit ago.  I suspect that their legal beagles were working on the issue at the same time.

Thanks for posting that, jsolie. I found the thread on IS and yes indeed it is the same person. I emailed compliance at IS and as I was typing the email, the message on the flickr contributor's site changed from oops the photo is private to The photo has been deleted. I am hoping that IS was on the case, too, and the combination has indeed shut this person down.

Whoever says we should just sit back and accept this as a fact of microstock life...I say "not on my watch!"

I have not, but I will certainly get to it. This image sleuth forum is now going to be on my regular watch.

edit: just got a response from IS and they have already sent a cease and desist letter. Thank you so much IS for handling these things on all of our behalfs. That letter coming from you is way more powerful than an email coming from me.

 Hi All,

 I found our images being resold by another party on Flickr for wall paper. They even changed one shot just a little bit by adding some window blinds. Photo is of my two dogs laying on my couch in my living room, so I am pretty positive it is mine. Found it through Tin Eye.

You should contact Flikr. As cclapper just had this problem. It seems to be a recurring problem now.

I found one of mine on Flickr also.  Although it is very small, it is available for download.
