Title: Heroturko ?
Post by: Black Sheep on June 03, 2011, 07:58
I wonder, what can be done against sites like Heroturko offering packs of stolen RF images ?

Those sites are our worst nightmare.

They claim not be doing anything wrong as they do not host any of our files, which is true.

However, the purpose of posting links to the files shows their intent.

Some of these sites even threaten with counter suing anyone who makes a false copyright claim.

They sure get massive traffic, hence money through ads, referrals etc. and it's giving me a bad feeling how "easy" it could be to make money if you just drop your morals and ethics, despite (supposedly) staying within legal boundaries.

I wish someone could take them down but that's what the music and film industry has been trying for years.

All they do is dragging mothers to court for downloading 24 songs suing them for $1.92 million

Good to see that Heroturko and the likes keep spreading the links for years without any consequences.

Those sites do get shut down, at least the ones that operate in countries that take copyright law seriously. HeroTurko and a few others that have been around for years operate in countries that turn a blind eye to infringement. Not sure where HT is based these days, but at one time it was in Russia. Garcya.us is based in Romania, another country that doesn't care much for things like the DMCA. And there are countless HeroTurko copycats out there, reposting the same content and links.

The only thing that works to slow the distribution of our files is to submit takedown requests to the hosting sites. DepositFiles, Rapidshare, HotFile, etc. The hosting sites do tend to respond to requests to remove files. But it's time-consuming to police the various sites that post download links and send requests for removal to the various hosting sites. It's a losing battle.

Romania now is in the EU but i remain skeptic.

The only thing that would work is to prosecute sites like Rapidshare. It will mean a change in the law making them responsible for any content they host.
You could say that they aren't doing anything wrong as all they do is provide a service hosting stuff, what goes up isn't their concern.
There's also nothing wrong with running a pawn shop, but if 99.9% of what you are buying and selling is stolen then you are no longer a pawn broker, you are a fence.

These site gain a lot of profit through advertisements. These should be shut down but perhaps even stock agencies knows about it and they themselves are not able to take any action as they claim for not hosting any link on their site.
I myself will be very glad if this comes to an end.
I can only suggest that there are many numerous site on the internet like that. Its better to focus on your work success (nothing personal) ...  ;)

Now that you mention it, we may not be able to make copyright claims towards these link sites but on the other hand we could make their advertisers aware of their practices.

I was just reading the user agreement of www.clixsense.com (http://www.clixsense.com):
Quote
11. ADVERTISER REQUIREMENTS
Any advertisement submitted for consideration to ClixSense will first be approved by our staff before being activated. Websites containing malicious script or code, excessive pop-ups, or viruses are prohibited. No site (url) that is approved shall materially be changed after approval such that the content of the site after the original approval is thereafter in violation of the terms of ClixSense. In summary, and without being exhaustive, no sites promoting the follow shall be submitted to ClixSense:

Adult Content or Sexually Themed Material
    Drugs and Drug Paraphernalia
    Tobacco Sales
    Discriminatory Practices
    Hate / Violence Sites
    Weapons Sales
    Pharmaceutical Sales
    Illegal Downloads
    Gambling

ClixSense reserves the right to reject advertisements at our sole discretion.

Google's Adsense has something along those lines as well in their TOS under point 5 here:
https://www.google.com/adsense/localized-terms (https://www.google.com/adsense/localized-terms)

I know this might be some work but if we could identify the advertiser and get a number of affected copyright holders together that complain simultaneously to the advertisers, then the site might become "unsustainable"  ::)

I don't think there are countless advertisers that they can sign up with.

Maybe someone who knows a bit more about their advertiser could chime in.

I have no problem reporting it to the advertiser once I find a link to my images on their site.

ohh this is nice...
I bet that even advertisers are aware for it. But since there TOS says so we can definitely claim copyrights :D

But advertiser will contact the website and web admin will go away saying that we do not host any file on our servers.
The only way to remove all these is to contact the host ppl (ie rapidshare, megaupload.. etc) regarding these issues and telling them to remove it immediately...

Contacting advertisers also works, they do pull their advertising from the site if you follow their procedures for reporting a site.
