My lawyer is contacting Google for deactivation of this image.

That sucks Suljo.  And it sucks that you have to pay a lawyer to protect your property.

Yeah it does suck, I was busy thinking how awful it was for the poor people caught up in this when I spotted a couple of mine in there too!
Let us know if it works for you.

Was your image part of the iStock/Getty deal with Google?

I found one of mine there as well.

Can I get $10,000 too please?

Good luck with this Suljo!  I think you are going the right route having a lawyer write to them.  Would be very interested in hearing their reply if you feel like posting it :)

unfortunately the response will be something like: "you shouldn't have agreed to istock's terms"

good luck though.. I wish the best for you..

Sure.  But that doesn't mean the letter had no impact.  They don't have unlimited resources, and don't want to be receiving letters from contributors' lawyers on a regular basis.

We want them to die the death of 1,000 cuts.

I wish this could be tested in court.
You really can't just go by the letter of the contract.

A court can rule on what reasonable expectations would be given the wording of the contract.

Given that the terms aren't that different from any other agency's (or those you sign with Facebook etc.), and how outrageous the Google deal is, I believe there's a very good chance a court would say Getty has acted inappropriately and against what a contributor could reasonably expect when signing off on the terms. Who would have thought a stock agency would allow their artist's work to be given away for free to millions of users?

I agree with you guys.. I think I was misunderstood..

I believe any court would and MUST say what you said there.. my post was about what IS would say :)

It's okay, I understood what you were saying and agree that they would respond in that way.

I was just saying that I hope it is tested in court at some point so they have to eat their words!

I Just want to disappear from google drive.

We continue to work with Google on improving the OBVIOUS ISSUES with the implementation of our content within Google Drive.
As you have probably read in the forums, Google holds a legitimate license to use these files so opting out is simply not an option.
In future, please refrain from resorting to the language you have used here. You are talking to real people who treat you professionally and that return courtesy is expected.
Regards,
Brenda
---------------------

So Conclusion is that they know that somebody screw things up in the first sentence "OBVIOUS ISSUES"
Second Gogle is clear because they have "Legit License" which our image reseller IS/GETTY dont show to us, 2 weeks passed while in that time our images are stolen or misuse there as feeding frenzy.
Third
OPTING OUT IS SIMPLY NOT AN OPTION

what fa cky F c k
----------------------
My letter to smacky support To iSmacks

-First of all sorry on rude words because all situation which is 2 weeks old make me angry without any coherently explanation from you side. From you QUOTE that YOU TREAT ME PROFESSIONALLY there is question for myself: Will you be my image provider or not. You don't give me choice to OPT OUT with this Third or Fourth kind of arrangement. Actually you force me to sign that fuzzy murky agreement (I just want sell my images in way as you site is doing from day one without unclear conditions.)

I understand actions as giving free images as promotion in adds or other actions, but that not means that my images can be given for free which any Google drive user can use Professionally, redistribute it and without any back link and with stripped image data and without any compensation to me or other authors which images are involved in this "famous deal" with Gogle.

Conclusion
You sad: Gogledrive is clear because they have "legit license" as you answer to me. Means that any free Gogledrive user can do with my image in the way what they want.
This kind of Selling/or Reselling FULL Image Rights was not represent to me/(us other contributors) for 2 weeks while my/other images are vulnerable and exposed at Googledrive as feeding frenzy.
I remember last year we finally to get rid of pirate "share" plunder sites and this year starts with Instagram crap and now with you unclear deal with Gogle.
-------------------------

Dear Sir/Madam at IS/getty whatever "support"
I just ask you to remove/take down notice just of my ONE image (Keep your fingers crossed that I don't find more of mine) which I find at Gogledrive (which "You IStock or Getty" sold to Gogle with unknown/unclear lisence to us.

1. For me it is unclear are you willingly ready to remove my image from GogleDrive?
2. You willingly want to remove my image from Gogledrive but you are incompetent or unable to do?
3. You just don't want to?
4. If you are unable to remove/deactivate or redeem my image from Gogledrive are you ready to compensate me 10000$ for SELL RIGHT license of my image without you 20/80% deal. Just 10k at my account / per image?
5. If you somehow succeed in redeem purchase pay me just 10000$ / per image.
5. You don't know what I talking/laments about?
6. AFTER ALL MESS YOU PROVIDED I DON SEE A DIME FROM THIS FAMOUS DEAL!!!
7. Which line I missed that you TREAT ME PROFESSIONALLY???

I found 2 images on GD some people have 5 even 10 images there. As a reward today I have been banned on their forums just for saying that something is rotten in the state of Denmark. I think you and me and others as individuals can't do anything. Maybe it's good idea to flood them with emails by all of us demanding to remove images from GD  spread this scam all over the web  as much as we can and finnaly all together collect some money and go to the court.

Have they even said how long the google-drive license is supposed to be good for?  Is it a one or two year term or is it a "forever thing".

And that indeed is the heart of the matter.
If the issues are so 'obvious', as indeed they are, why was the deal signed off by Getty in the first place?

Doesn't really matter, even if it was just one year the image is totally valueless by then!!!

I think the holding company that owns Getty and Istock sees a trend in the micro stock market and is trying to extract all the profit out before dumping or putting into bankruptcy both companies. They do not care about of the photographers or other artists that may get hurt in the long run by their actions

Companies also tend to go public to cash out when they hit their peak and the writing is on the wall.

I can't believe that because they paid $3.3 billion.  They aren't going to get much of that back selling a few thousand images to Google at low prices.  I'm sure they have a plan but keeping us in the dark is wrong.  They're an agent and they need to tell us what they're doing with our images and get our consent before they make deals like this, not after.

Agree 100%. Getty deal with Google proves this - Grab the money and run!

Could someone post a link to the images page on Google Drive? I can't seem to get to it anymore. I just wanted to check & see if they have any of my images or not. Last I checked they didn't, but they've added a lot since then, so I want to recheck.

I don't know about lawyers, but when you go to your doctor it is usually not a good sign if he calls you 'an interesting case'. :P

It very probably is, in the first batch it was 12,-$ than they thought 12,-$ commission is way too much money for a complete buy-out of all photographers and models rights and the reduced it to 6,- $ for the following batches!

The same here, not a single dime and what´s even more "interesting", my photo that appeared on GD have zero sales on IS...so have no clue what´s going on here.
