TinEye found an image of mine here:

The blogger gives credit to an online magazine:

I wrote him and explained about this. He is a congressman.  Let's see what he does.

It is obvious once again that people think they can use anything they see online.  He even gave credit to the original site, so he thinks it is ok.  The image illustrates a next to which is from an online newspaper...

BTW, doesn't an online magazine fall in the same concept of editorial usage that requires credit to the agency and photographer?

Does anything require editorial to credit the agency and photographer or is that just what some agency licenses demand? You would need to know who sold the image, before you could answer the credit question? If it's not listed, you'll never know, which is kind of circular, since you can't tell who sold it, to see if the contract requires credit to the photographer. Confused?
