Once more, I found one of my images on FlickR. Other images in the same gallery look like typical stock images. Maybe one of yours is there :

I tried to send a copyright infringement notice to FlickR but they redirect me to a Yahoo (France) form that I have to fill and send by tracked snail mail. Any other way to send an online notice ?

(I don't have a FlickR account, so can't leave a message to the user)

It looks like the site author gathers images for use on the site/blog. So try contacting there. If you find your image in use on that site/blog. Personally I would just send a DMCA takedown notice to the host/provider. This crap is getting tiring.

It looks like the site author gathers images for use on the site/blog. So try contacting there if you find your image in use on that site/blog or want to give them notice about Flick. Personally I would just send a DMCA takedown notice to the host/provider for the money site. This crap is getting tiring.

Edit: Boy busy day today and brain not entirely engaged.

It is possible that the author purchased images for use on the site/blog and may be trying to use Flickr as a host and is either unaware of rules or is ignoring the rules.

So with regards to use on the site/blog, the use may be entirely legit, it's just the Flickr thing that is in question. They may using Flick just as a linking mechanism to try and draw traffic. Then again, if an image is found in use on the site/blog that you have never sold, well than that's another issue, in which case the DMCA takedown could come into play.

The Flickr user is just probably keeping images on Flick for further web usage

Both of you are probably right, but the way I found this flickr page is because I found my image used on many other websites that hot-link to this image or even credit this flickr user as the source of the image. They probably think that this image is free to use as it is on Flickr.

Click on the Copyright/IP Policy at the bottom of the flickr page and there is an email address to send a DMCA notice to. Also, search this forum, in the Image Sleuth area, too. Several of us have posted the legal letter you can copy and paste for your email because they require a specific format. They detail it in their 6 numbered items at this link, but it has already been all written out for you.

Thanks cclapper, I'll look into it.

[EDIT] I just went to the english flickr page and clicked on the Copyright/IP Policy link, but it keeps redirecting me to the Yahoo France page with a form to fill / print / send. It seems the process is different for different countries.

elescher68 user on flickr is using other photographers stock photos.
I sent an email to Flickr about mine but there are many other photos that are stock from other photographers. The worst is that they have no watermarks.

I contacted Flickr and they seem to work on this. They asked me to complete my request by adding these:

1. A valid address and telephone number where we may contact you.

2. A statement that you have a *good faith belief* that the use of the
content in question is unauthorized.

3. A statement by you, *made under penalty of perjury,* that the
information provided in your notice is accurate and that you are the
copyright or intellectual property owner or authorized to act on the
copyright or intellectual property owner's behalf.

I posted a courteous comment on that image of Sharon Dominicks regarding copyright infringement. Hopefully it will fend off other freebie-seekers.

Gosh, I had no idea it was you, Michael!  Although if I had looked closely at your picture I would have recognized your dog - one of the cutest in the stock world ;D

Good catch on finding these misusages.  FWIW I have had very good luck with Yahoo taking down my images when I have found them on Flikr, as long as I sent them the DMCA letter (which contains the same language they asked you for). 

Best of luck getting this taken care of, and thanks for alerting the rest of us!

This was my first post ever so. I have been a spectator on this forum but I had to act on this flickr user.
Thanks for all your help guys, I found an example of letter and emailed to Flickr.

They didn't waste time. They took it out and pulled the trigger. Yes! The photos are gone :-)

It looks like the offending photos have been removed:



but as usual, no real punishment to the uploader. He/she still has a flickr account with a photostream. I still see one photo that looks pretty professional, but difficult to tell since IPTC data has been stripped. I wonder why that happens and why Yahoo/flickr can't leave the metadata in. Then the rightful copyright holder would be there.
