Title: Too Fast Apparel
Post by: Renee on September 12, 2013, 12:23
I found a bastardized version of my artwork there. You may want to check their sites for vectors if you work in the day of the dead style.

Of course I contacted them they claim that it does not even look that much like my art they asked how long have you been selling it as we have represented this artist for awhile. It is a direct theft where the skeleton's fit directly and the bones in my drawing were used to make the roots and leaves of the cannopy. This company first defended themselves by saying well its royalty free, well royalty free is not t-shirts and I am the only one that can authorize them

I looked over at your SS portfolio (these pictures) and I don't think it is similar too, can you show us more?

they took image number one put them together copied bone elements and replicated them, there are so many hand drawn hand traced then digitized then hand drawn, it is not a good rip off

Here first see how different you can make my art

are you the only person that had this idea? there weren't any similar works before yours? I still don't think you have a case here unless you can find any portion of your work in the supposed thief work

I am going to check into that as the concept is mine this is a derivative I am just placing mine over theirs now, but how so you prove some is ripping off your work while trying not to rip off your work so they change this a little of that and they think they created something they did not. Thank you for your input, it is obvious that this work is using my work to inspire their forgery. It is a disgusting way for a company to avoid paying for art

When rotated and placed my couple with the child fits

I think I'm with Luis on this.  You might have been the first one to come up with the skeleton/tree concept, but it doesn't appear (to my untrained eye) that they actually pulled portions of your art to make this.  Maybe they saw your art and decided to do something similar, but you can't copyright an idea or concept... so while they get no points for originality, they're almost certainly in the clear, legally speaking.

If you haven't put your art online don't do it! This is not worth it. People trace a tracing of a tracing and they feel they have a right to it, legally I could win would it be worth the time I doubt it because the reality is there are more Annabelle Bow types stealing makes money morals are outdated. This is a good example of what I never expected when I uploaded something that meant something. I never expected Inked magazine would be selling stolen versions of my art but why not there are so many jerks

I'm with the others on this. It's a cheesy thing to do to copy somebody's idea (if they did that), but I'm not sure they did anything legally wrong.
