Is it time for a FOAP sub forum in the "New Sites / Low Earners" area?

I've about 150 photos uploaded with about 100 of them being "real" stock images compared to random crap photos I've taken on my iPhone.  I've two sales so far.

I'm holding off uploading any more due to this part of their license that worries/confuses me:

Quote
"To Foap. a worldwide, non-exclusive, royalty-free, transferable license (with right to sub-license) to use, reproduce, distribute and display Content within the scope of the various functionalities of Foap Market from time to time and within the business of Foap, including without limitation promoting Foap Market or redistributing Foap Market in any media formats and through any media channels."

I think there is only about 3 forum threads about FOAP.  I'll let it become a little more popular before adding a forum area.

Not interested in any more stock or photo sites with license terms stating "we can use your photos for anything,  and resell them however we want, forever, and if that isn't good enough we can change the terms unilaterally at any moment."

What part took forever?  It's all crowd sourced and instant.

It's hit n miss.

When inquiring about the details of their license, specifically the "right to sub-license," this is their response:

Quote
As a webbagency you can buy a photo and use for brand that you work with. You cannot let the brand use the photo, but you can use the photo. And if a company buys a photo they have the right to let journalists use the photo if writing about them.

Kindly,

Madelen

It sounds like they're simply allowing the use of the image with respect to marketing or portfolio use for the client.

So if Company ABC buys an image and makes an ad, they're then allowed to use a copy of that ad for editorial purposes, such as displaying their previous work.

I'll try and get more details out of them.

An update, incase anybody cares :P

My question:
Quote
Does this mean that a customer, say Company ABC, buys an image from Foap, they are allowed to then relicense the image to Company XYZ so that Company XYZ can do what ever they want with the image?

Their response:

Thank you for your reply. No, it's not that the Company XYZ can use the photos for whatever they want. But if the Company ABC is working with marketing for Company XYZ, Company XYZ may also use the photo for their use, but not for example to sell the photo. Do you understand what i mean? Please let me know if you have any more questions. :)

To me this sounds more like a company that bought the image can give it away for free to the media if they write about them (most commonly combined with a press release). Most other agencies have the Extended Licence for that, because I have had many cases where the press release with my images had been reprinted more than 100 times.

Just for an update and in case anyone else bumps into this place.

Reviews are done by other photographers. Usually approved in minutes. It's kind of odd because one person will give 5's for everything and someone else will stick 3's on things, but they get approved. What's the difference? Well rating effects placement. Have to laugh. But anyway, it's fast.

The Foap community (= you/ other photographers/ users) are reviewing all the photos and has the power to decide if they should get approved or not.

When you upload a photo to Foap you need to rate at least 5 photos to get your own reviewed and approved by the community. So for every time you upload a photo you will have to review and rate 5. In this way we let the community decide if your photo is good or not.

To get published to Foap Market you need an average rate score of at least 2,5.

FOAP also has Following and Comments for social interaction. It's really designed for smartphones and you can access it on the web, but loses much of the functionality. Can't see sales or financials and some other features, using the WEB, but you can on your phone. So if you are looking at the site, to see how it works, use a phone, or you won't see what it's really presenting.

I have one sale. (a microstock reject, that no site except SnapVillage ever took) I uploaded a bunch of old photos from my micro collection, my iPhone 3GS doesn't produce good enough images. Good luck getting images from a computer or card, onto your iPhone and uploading. Easier on Android. (When will you launch an Android app? Our plan is to launch an android app as soon as possible.)  Did they ever do that?

Flat rate pricing $10, commission $5 a download. For people who think 50% of nothing is a great deal, this is the place for you.

I started a free forum, posted a link on the FOAP Facebook page, and in six months, got one user. I'm letting that forum die. That should say something about interest and the need for a sub-forum here.  ;D

But for someone who wants another outlet and has all kinds of spare time, you might want to try Foaping?

Personally, at this point, it looks like a waste of time. Maybe if I was shooting social media type shots with my smart phone, it could be better. Nice simple system. Peer review is interesting, even if flawed in some ways.

I think they have some referral thing, hard to find it. Say "Uncle Pete" sent you?  ;)
