Post by: videocreative on April 19, 2015, 09:36
Hello,

How to sell legally movies pond5, videohive, Shutterstock? With SLR Canon, Nikon, Sony, etc. in the manual is the information:

AVC Patent Portfolio License

This product is licensed under the AVC patent portfolio license for the personal and
non-commercial use of a consumer are (i) encode video in compliance with the AVC
Standard ("AVC Video") and / or (ii) decode AVC Video that was encoded by a consumer
engaged in a personal and non-commercial activity and / or was Obtained from a video
provider licensed to provide your AVC video. No license is number granted, or Shall be implied for any
other use. Additional information apr be Obtained from MPEG LA, LLC
See http://www.mpegla.com (http://www.mpegla.com)

Videos of the SLR can not decode and convert Quick Time Photo .jpg? for sale? You need to buy licenses from MPEG.LA? What are the fees for licenses decoding and converting?

Do we need to have codec licenses Quicktime Photo Jpg after conversion with h.264 (Canon)?

You can not convert a free program with Video to Video and MPEG_Streamclip? I know that these programs do not have a license for codecs  :(

Do you know of a free converter that has a license H.264 / AVC to convert to Quick Time Photo Jpg?

Nobody knows?

Basically we need our own licence then to submit MPEG or decode to some other format, is that correct?

I think that's true. MPEG Streamclip SQUARED 5. There is a licensee of the list of companies http://www.mpegla.com/main/programs/AVC/Pages/Licensees.aspx (http://www.mpegla.com/main/programs/AVC/Pages/Licensees.aspx)

Many other free converters, there is no list of licensees MPEG.LA.
If we convert H.264 / AVC to another format and codec. You must have a license from MPEG.LA if you do not have a converter programs  and do not pay license.

We sent an email to MPEG.LA and got the answer.

Hello,

I have a quick question. I record videos Nikon codec H.264/AVC. Do not want to violate the license H.264/AVC.

Can I change the free converters H.264/AVC on Quick Time Photo JPG for commercial purposes? Pond5 pages, VideoHive ...

For example, a free program Squared 5 MPEG Streamclip is doing the conversion.

I know that MPEG Streamclip Squared 5 is not a licensee MPEG.LA

http://www.mpegla.com/main/programs/AVC/Pages/Licensees.aspx (http://www.mpegla.com/main/programs/AVC/Pages/Licensees.aspx)

Pond5 recommends the program to convert videos MPEG Streamclip

http://help.pond5.com/hc/en-us/articles/200944183-Video-Upload-Specifications- (http://help.pond5.com/hc/en-us/articles/200944183-Video-Upload-Specifications-)

That's why I prefer to ask you and make sure it is compatible with the law.

I received a reply:

Thank you for your message. It’s good to hear from you again.

Although our Licenses do not directly provide coverage for an end user and anyone in the product chain has liability for an unlicensed product, a royalty paid for an end product by the end product supplier would render the product licensed in the hands of the end user. But, where a royalty has not been paid, such a product remains unlicensed.  In that regard, and as you correctly noted, the party offering the software product you mentioned has not taken a License or paid the applicable royalties. As a result, their products are not licensed.

For that reason, we suggest that you choose a product from a licensed supplier (or insist that the supplier you use become licensed by paying the applicable royalties).

If I may be of further assistance, just let me know.

Does anyone understand English well. The authors of films we are required to pay a license for MPEG.LA?

Complex and needs more details from them in a FAQ style.
For me by this answer they want to have royalties for them on every conversion and converting software should be of type SAAS, recording every operation. We can continue to guess more.
Thank you to you that you asked them

The fee is for MPEG.LA 0.20 cents from the sale of fimu on Pond5, VideoHive, Shutterstock and so on. It does not matter whether it was to convert H.264 / AVC to QuickTime Photo Jpg is 0.20 cents. I'm so private lawyer said. This is highly not much. And if you do not pay interest can grow ... It is better to pay 0.20 cents per MPEG.LA if filming SLR H.264 / AVC. I would like to warn everyone here.

Shutterstock is licensed, is on the list, and the authors do not have to worry.

Istock, Pond5, VideoHive not have a license for the H.264 / AVC, so the authors themselves have to buy licenses MPEG.LA  :(
