I am only three months into the world of Microstock and still in the process of understanding the various nuances. I have a question about the fact that there were no tax forms (W9 or W8-BEN) to fill at Pond5.

My limited understanding of the stock agencies tell me that all US-based ones will mandate a tax form. This is what happened to me with SS, DT and FT. The non-US-based ones will not have to do that and I did not have to fill any for iStock, CanStock or 123RF.

Based on what I gathered from Pond5, they appear to be an US-agency. But they do not have a Tax section to fill out W9 or W8-BEN forms. My question is:
1. Am I correct in my understanding that Pond5 is a US Agency ?
2. If #1 is 'YES', then what should non US-persons (like me) do about the US withholding tax as Pond5 clarified that they will NOT do any withholding ?

Thanks Beppe. Yes, I did ask them. The reply I got from them was: Thanks for you inquiry! We do not withhold any money for taxes, so you would need to estimate your taxes on earnings from your end.

My thinking is that this would be OK if they are NOT an US agency. But if they are (which I am not sure), then I am not sure if they can do without the withholding.

Thanks Beppe. When I called up support last week, the person did mention that they have offices in NYC and Geneva but was not able to tell me if the NYC office was the head quarters or the Genava one. So, I did not get to conclude whether Pond5 was US based or not.

No problem. If I get any more clarity in the future, I will post it here.

Thanks PhotoGirl ! I saw that thread to. Then my #2 question becomes valid ! but I guess I will have lots of time :-) I am seeing the comments from Gillian and also have seen many with amazing ports reporting no/hardly-any sales.

I will look to see how to handle this if the agency wont do it on their own. If I find out something, I will  post an update.

I was just fishing out this topic, as i'm going through the same process as the OP in 2013.

Is it true that Pond5 doesn't do tax retentions? can anyone help here?

but they send it to you? or do you have to previously fill out a form?
The thing is that usually with the agencies i have to fill out a form, confirming that i'm not a us citizen (or tax payer there), for retention purposes. in Pond5 i don't find it...

I believe all agencies have some sort of initial tax interview you have to fill out, sometimes before you even get paid.  I think it's a W-9 for US citizens.  Not sure what to do if you're international.

So yes, I had to do something in the beginning, but that was years ago.

They used to mail me my 1099, but now all agencies just put a PDF up for you to download.

I don't think Pond5 does international tax withholdings... not sure how they get away with it.

They send me a tax form, but Im in the US. A friend from outside the US with no tax treaty doesn't have any withholdings.

They have  pond5 ireland for european countries and work from there so no withholding. Bigger problem is the one larger Stock agency that withhold taxes but dont send legal forms. More about that very soon.
