Dear Pond5 Artist,
We are thrilled to announce that we are expanding our Exclusive Video Program! Beginning September 25, 2023, all Exclusive artists can also sell their Pond5 content on the Shutterstock marketplace. This gives you the opportunity to expand your reach while still taking advantage of industry-leading royalty rates on all Pond5 sales!
 
Heres a bit more info about what this change means for you:
Changes to the Contributor Agreement will take effect on September 25, 2023.
Selling your work on Shutterstock is optional. To take advantage of the new extended reach:
Existing Pond5 Exclusive Artists can register as Shutterstock contributors and upload their exclusive content directly to Shutterstock, independently of Pond5.
Non-exclusive Artists with content only on Pond5 and Shutterstock can now upgrade their Pond5 accounts to Exclusive using this sign-up link.
Non-exclusive Artists can join the program by signing up to become Exclusive and removing their content from all other marketplaces (except Pond5 and Shutterstock) during the two-week buffer period.
All Exclusive artists earn an industry-leading 60% royalty rate on Pond5 video sales with up to 90% on new customer referrals through our Pond5 Refer & Earn program.
Pond5 Exclusive artists still have complete control over their pricing on Pond5.
Shutterstock does not have an Exclusive program. Shutterstock contributors will earn royalties for Shutterstock sales according to their regular terms and payout schedules.

I think it is fair enough. Nobody is forced to do anything. You can pick and choose which files you send to Shutterstock.

Might make more people consider going exclusive with pond5. Especially if you do a lot of editorial. Adobe and istock don't take real editorial video.

Yes...you will get the sales at the SS level...good and bad...

But nobody is forcing you into it.

I am sure many people will do this, send the best work only to p5, the outtakes or weaker files can have a double life.

Since my account was purged from SS under the previous management, I cannot take advantage....

But I think it is a good offer for all those who want to do this.

There are still people happy with their video sales on SS.

For me it will be p5, p5X, Adobe and BB and a few other smaller places.

If I still had an account on SS I think this combo could be very useful for editorial content.

Everybody makes their own decisions.

Yes, it is autumn again.

Exciting announcements from agencies incoming.

But since there is no force here, it is actually a genuine offer.

Quite apart from the fact that everyone makes and should make this decision for themselves, one question popped straight into my head:

If I offer via Pond5 at Shutterstock, do I get a 15% share from Shutterstock and this amount is then split again 60:40 with Pond5?
In a 25 cent sale, 15 cents would remain for the contributor.

Shutterstock would then earn twice as Pond5 now belongs to Shutter.
Or am I thinking too complicated here?!

They are not distributing your p5X content to SS.

You must have a SS account and upload individually into that one.

And on SS you have to go through their yearly ranking system...

It would certainly be easier if we could just upload once to p5 and then select what goes to SS from there.

OK, I see - thank you for the clarification!

Maybe I'm already thinking too confused, after all the exiciting news of the last 2-3 years :-)

Edit:
If you are allowed to upload the exclusive Pond5 videos to Shutter, this is an offer that everyone can consider for themselves.
Here, everyone has to calculate lower prices in exchange for more sales.

I think we are all a little crazy by now.

I mean, why am I even commenting on a program I cannot even take part in because the previous managers purged my SS account???

I really miss the old Shutterstock, it was a fantastic place.

Nevertheless, I think this is a very fair offer.

And will calm a lot of people down, because I know many artists who are terrified that p5X accounts will have their content transferred against their will and by force to SS.

IMO within stock agency site offerings only buyers can determine what is the "best" work  - not the video/photo producer.  It can be surprising what stock videos/photos are licensed.

To me this announcement makes no sense and is based only on a dubious lure of an "opportunity to expand your reach" and dilutes the premise of having Exclusive content on one platform.

Sounds like SS has started looking into what changes they can make to P5, honestly this is really exciting and I look forward to all the changes they will make to P5.  At least they haven't forced mirroring yet, but it is probably only a matter of time before they start making real exciting changes.

I appreciate the option to choose, but I am doing exactly the opposite. Not only I don't and will not submit my exclusive contents to SS, I also try not to upload the same non-exclusive contents to P5 and SS.

Why? P5 will not pay you the price of your choice, if the same content is selling elsewhere with lower price.

This email does not explain how my exclusive contents are priced in SS. That question must be addressed directly.

This is a good offer from pond5 for those who are exclusive authors. Now such creators can upload their videos to Shutterstock, which will increase their income.

For those who have Exclusive account in P5 these news might be a kind of a trap... 

A practical example:

Based on production, equipment and post-production costs, an exclusive contributor can mark a clip at P5 at 100$ and if it sells, the earn is 60% or 60$.

Now with this exciting opportunity, SS marks the clip usually at 59$ but the contributor only earns close to 8$ if we consider a level 1 earning breakdown of 15%. However, this adds to the problem that P5's contract highlights that if the clip is on sale for a lower price then P5 will be able to do Match pricing.

In short, if an P5 exclusive Contributor upload to SS he will be held hostage to the prices SS wants on both platforms despite being exclusive in P5 and will receive much less in terms of RPD.

Actually that does not appear to be the case.  The P5 Contributor agreement section for Exclusives specifically excludes SS and its companies as Other Marketplaces subject to the P5 price matching.

I PCDMedia i think you're right!

I am reading both Agreements now (old and new) and i find no difference in article "3. Pricing and Your Share of Net License Revenue", section 3a, V.  "notwithstanding anything to the contrary provided in this Section 3.a., you shall not set the price for an item of Content that is higher than the lowest price for which the same (or substantially the same) Content item is offered by or on any other media marketplace, agency or other redistribution arrangement (each an "Other Marketplace"), and if we discover that the Content item is offered at a lower price by or on any Other Marketplace, we may lower the price in our marketplace to match or beat that price."

Although i find something NEW in article 4 "Exclusivity Program for Video", f) :  "Unless and until the Exclusive Period is terminated under the prior paragraph e., you will not offer, market, license or provide any video Content or any Similar Footage to, on or through any Other Marketplace; provided, that for purposes of this Section 4.f neither Shutterstock, Inc. nor any member of the Shutterstock group of companies shall be deemed included in the term "Other Marketplace".

So as far as i understand it means you can upload SS or SS group of companies and we don't have Match pricing going on for exclusive P5 with SS  because its not consider other marketplace. Nevertheless i think this should be clarified in article 3a V and not just in 4.f

If the price that SS puts is lower, and it is always lower, I think customers will buy the clip wherever they find it cheaper because that's what I always do and I don't consider myself smarter than others. It's just very easy to search for the image on Google or with price shop devices and see which one has the cheapest price.

As exciting as the news is, I will not upload to SS. I think I'll leave everything as it is, wait and see  ;)

We must be realistic believing we have complete control over our P5 pricing - Exclusive or not.

The P5 Contributor Agreement section 3.a.i.  has the onerous clause that states:

"we (P5) will have sole discretion to adjust the price of any Content to maximize your overall revenue performance or comply with our minimum pricing guidelines;"

It seems that SS is trying to make P5 less competitive in a long run. 

Even though I am at Level 3, most of my SS sales are at 0.25(clip pack). How many clip pack sales that I will have to make in order to get the earning for one sale at P5? Go figure.

Let me guess ...... Al most 1% of P5 exclusive contribuyors will take this exciting new SS offer  ;D ;D

The day I am forced to sell my clips for cents at  SS i am out as quick as a lightning bolt. I did already step out and delete thousands of videos from Istock for the low amounts SS id even worse
