Title: Can you use microstock photos for Zazzle, Cafepress, etc?
Post by: bsites on October 19, 2009, 14:06
I've been looking at all of the posts about selling business cards, t-shirts, prints, etc. through various websites and I was wondering if I could use my existing microstock portfolio as the images?

I would assume so since I still own copyright, but was curious what everyone else did.

Yes, you can definitely do that. Quite a few of us have already used their photos in those designs and products for sale.

What do you mean, images sold by you on microstock or images you purchased on microstock?

My own images that I sell on microstock sites. I just didn't know if the microstock companies frowned upon us selling our images through other merchandise-type websites.

most microstock offer only rf licences, which means you can sell on multiple sites anywhere, mugs and t-shirts included. the only exception is if you have an exclusive relationship, but even then i think it's ok for selling your own products.

I guess as long as license is non-exclusive you can sell image wherever you want.

I believe that even IS exclusives can do it with their images on Zazzle and cafepress for example.

Exactly.  From IS Exclusivity FAQ (http://www.istockphoto.com/sell-stock-photos-exclusivity.php):

iStock does not require Exclusivity for:

    * Rights-managed files with other organizations
    * Personal portfolio sites
    * Work for hire/editorial work contracts
    * Prints for sale
    * Prints, t-shirts and the like produced on art-only sites such as cafepress.com

Sounds great! I only wonder if these products really sell. Any experiences so far?

I only have a small store so far on zazzle and I've made two sales, one of which was something I bought so I could check quality. I think others with larger stores are reporting sales.

I am happy to report I bought my own calendar on zazzle and it got here quickly, was packed well, and the quality of the printing is excellent.

Looks great! I have started my shop in the meantime, I have tons of ideas and even more photos. The weather is terrible here so no way to produce some new work but this is a nice thing to work out during these rainy and stormy days

I sold a tie today. It is really hideous. I hope it not someone's Christmas present!  :-\
Ah well, it all adds to the coffers.

it is okay to use our own RF images... how about RM images? can we use it for zazzles product? do we need to inform our RM agencies about it?

That would depend on your agency and what your agreement with it says. You need to read you contracts to find out.

Alamy's contract says you can do whatever you want with your photos.

I don't see that at all. I see a very complicated contract with lots of implied obligations on the part of the photographer. Can you direct me to the clause that says "you can do whatever you want with your photos"?
