The use of microstock SL in Zazzle

I was reading some threads in the Zazzle forum and some people discuss about the use of stock images in their templates.

What most want to do is to place a sample image that the buyer will replace for his own image - a family photo in a fancy frame, for instance.  And they say that for this a SL is enough.

I believe that, unless you make it very clear that the image is not to be used in the final product (like adding the words "sample" on it), these products should only be available in the photo ws purchased under a EL.  The fact that people are not expected to use the image doesn't mean they won't - they can.  Am I wrong?

Fotolia is cited by many of them as a source of images.  I thought of reporting those threads to them.

How could we go about getting that changed? I don't have the ear of anyone at FT (or any other agency for that matter!) so I know that they won't listen to me!

You're perfectly right, Adelaide. I believe it is Zazzle who should make this very clear to its contributors. Right now I don't think they provide much guidance when it comes to proper licensing.

I would think that would be an acceptance use for an SL. The buyer of the photo frame is not buying it for the sample image anymore than someone buys a book mainly for the cover. The image itself is not being 'resold' as such.

I bought a new baking dish the other week and, as part of the packaging, it had a large microstock image of fish & chips lining the base of it. Similar to the photo frame it was illustrating the product in use (I guess in case people struggle to understand what a baking dish or a photo frame might be used for).

Gostwyck, I agree it is an acceptable use the way it was planend - a sample image.  My concern is that someone may use the product without replacing the image and that overall people there don't seem to know much about licensing restrictions.
