I've been slow to read all that's about to happen with StockXpert, even though I'm on there and opted into subs recently (although the majority of my sales are still outside the subscriptions).  Reading the rules on photos.com, the fact it states a subscriber can "Use the Image(s) on product packaging or in any items for personal use or resale, including book covers, calendars, consumer merchandise (T-shirts, posters, art, etc.)..." is a bit much.  Any items for resale?  Can someone tell me if this is common in EULA's with other sites?  I think such use is prohibited in StockXpert's License Agreement.

Sounds like someone could buy any image, go onto Zazzle or wherever and set up a gallery to sell images as posters, note cards etc.  Probably a good time to opt out of subscriptions.

ImageCatalog seemed a good idea at the time.  20 photos on there for over 3 months.  Lots of views but $0 in sales.  Put 9 of those same photos on Shutterstock for the first time just over a week ago and have had over 100 downloads in the first 5 days....and counting.  I have the same bad luck (with the very same photos) on Dreamstime ($0), iStock ($0.26), Fotolia and 123RF.  Have been on those 5 sites for 3 months now.  Seems only Shutterstock, StockXpert, Big Stock and Cutcaster customers have any interest in my photos.  Odd.

That particular wording in Zoonar's Terms Of Service for photographers is what had me put my application with them on hold, and what had me search on the forums here to see if others had the same concerns about the wording. 

At present, their wording states that the photographer "transfers to Picture Agency all (copyright) rights of use of the picture material for every kind of commercial and/or non-commercial use".  Regardless of whether it says that in the original German contract, it's clearly there in English as part of the legal contract.  There's no getting around that.  I would like to continue my application on the site but will refrain until they correct their wording.

Wording unchanged as of July 2008 - even though the post on here about the possible mistranslation was put on here 2007.  Thinking it won't be changing anytime soon.
