I've written the word "homeless" in releases with this situation and not had any issues. It's been several years however so things could have changed.

Hi Lisa,
I think that point could be made with any license agreement in any industry. Layer upon layer of lawyer upon lawyer creating massive documents everywhere. I haven't read the terms and conditions of other sites closely but I would predict there is potential confusion in most, if not all documents such as this.
The first paragraph of the restrictions seems to me to be as clear as can be however:
"(a) No resale: The Member shall have no right to sell or otherwise distribute the Work or any reproductions thereof to any third parties, whether alone or incorporated or together with or onto any item of merchandise or other work of authorship, in any media or format now or hereafter known, unless: (i) the Work has been modified to the extent that it is no longer substantially similar to the original Work, provided however that the modification must be sufficient enough to qualify as an original work of authorship; and/or (ii) the primary value of the item being sold or distributed does not lie with the Work(s) themselves. For greater clarity, it is noted that reproducing the unmodified Work on mugs, t-shirts, posters, or other similar merchandise for resale is not permitted, as primary value would still lie in the Work itself. "

Hi guys, To set the record straight, DPC does not offer Extended licenses and does not allow for Extended license use with the images. The term "unlimited" referenced above is regarding the print run which is unlimited. The license agreement can be read here and is pretty straight forward: http://www.dollarphotoclub.com/Info/RoyaltyFreeLicenseTo clarify, DPC members cannot use the images on objects that will be resold where the primary value is found with the image. No coffee cups, greeting cards, tee shirts, etc. They cannot distribute the images to multiple clients. To do so they would need to purchase the image each time, etc. For that type of use, DPC members are referred to Fotolia.com where they need to purchase an Extended license. Cheers, Mat

Yes, Dollar Photo Club is using the Fotolia api. Sales through DPC are posted to your FT account with a subscription commission.

If you were opted out of Extended licenses and now all of your images have EL's priced at the minimum of 20 credits you can email support to request a bulk change of the prices. The change will be made fairly quickly.

Did you sell your unsold images to PhotoExpress back when they were buying our content? You should be able to contact their customer service to have your content pulled assuming you aren't still in the time frame of your agreement. If you never participated in the agreement then your content is from the FT api. If your FT content is closed out then PhotoExpress should be too. Contact them directly for more info.

Hi all, I looked into Dollar Photo Club. It is an affiliate site that is using the Fotolia api program. The database on Fotolia is mirrored on this site as it is on many other partner sites. The difference is that Dollar Photo Club isnt available to everyone. It is an exclusive club (not exclusive content) that is going to be made available to heavy buyers. The sales from Dollar Photo Club take place through Fotolia (as do all api sales) so your commission remains the same. It is essentially a giant subscription. You will receive the same subscription commission you would if the image were purchased directly from a Fotolia member with a subscription. This is another way to drive traffic to your portfolios and should result in an increase in overall sales for each of us.

Ron, I recall I wrote a very detailed response about most of these exact images when you posted them regarding your application to Stocksy. If you really want me to personally critique these images I will be glad to do so. Please start another thread however as I think it is inappropriate for you to hijack this thread to try and prove a point.
The person that started this thread is anonymous. I have no idea whether he has uploaded solid stock imagery or is just starting out and has some work to do. We all have room for improvement. Lord knows, I do.

I haven't shopped around on this but I would imagine you can get the 24-70 f/2.8 L version 1 for a much better price now. Check ebay for sellers that are upgrading to version II.

Yes, I agree with you all...the 24-70 f/2.8L II is a great lens. Very sharp, very fast. Others lenses I use about as much are the Canon 16-35 f/2.8L II and the Canon 70-200 f/2.8L IS. If you plan to only have one lens, then the 24-70 is really the only choice in my opinion.
You will love the 5D Mark III, it's worth every penny!

Thanks Reckless, it is definitely a lot of fun and each show presents a unique set of challenges/opportunities so it's difficult to get complacent which I love. Some of you that know me are aware that a big part of my photograph focus has been in the entertainment industry. While I cover all areas of entertainment, my primary focus has been with live music. 2013 proved to be an epic year for me as far as surreal experiences are concerned. I've put together a 3 minute video featuring some of my favorite concert photos captured in 2013. Check it out if you have the time.

You are choosing the easy way out here Ron. Of course we wouldn't upload our photos if we didn't think they were up to snuff. I've been a photographer for a pretty healthy chunk of time and I've accomplished some things that I've never though possible. That being said I look at photos I've taken in the past..heck, even as recent as this year and vividly remember thinking that photo was amazing when originally posted. When I look back at it without the passion involved I see my work with fresh eyes and often cringe. Personally, I welcome honest, productive critiques. I am constantly looking for ways to improve my skills as a photographer. I've been around some of the very best shooters on the planet and I have yet to meet a perfect photographer. We've all got room to grow. The minute you start to become complacent and over-confident is the minute you get passed up by hungrier and harder working photographers. This is not a career path for people with thin skin. Rejection is an ever-present part of our reality. You can choose to take it with a grain of salt and learn from it or you can get defiant and bitter. Sometimes I do the latter as I suspect does everyone from time to time. I make a conscious effort however to accept my rejections with humility. Life it too short to get wrapped up in the negative. -Mat Come on Matt, you know the rejections at Fotolia are nonsense. The laundry rejection list makes no sense 90% of the time. Fotolia is notorious for its rejection madness.

Tax rates are governed by the tax treaty between the US Government and countries outside the US. As far as I know, Fotolia has no control over that rate. The commission on images sold to US buyers would be subject to the withholding determined by the treaty between your country and America.

Forgive my ignorance here Luis, I don't get what you are saying. Can you be more specific about what I said that wasn't true? Please be sure to quote me verbatim. Thanks, Mat "Please note that after 6 months (180 days) without a sale, content prices are automatically set to minimum price (see pricing chart below). Afterwards, if the file sells 3 times in a period of 6 months, the contributor will once again be able to update their prices.
I have tons of files older than 6 months but sold after 6 months and before 24 months with reduced pricing, so the 3 times is official, again Mellimage was right and Mat wrong, this is becoming a gigantic joke and we deserve some respect, I am done discussing this matter, heading to the beach because this is pathetic and not worth the headache
