While it's not specifically detailed in the terms restrictions item ii. it states including but not limited to . Which might be interpreted as you can't use a image of a model to misrepresent it as yourself. Have your husband write them stating it is his likeness that they are using saying it is them and need to take it down.

Several years ago I was able to observe turtles laying eggs in Costa Rica. If I remember correctly the turtles prefer non-moonlit nights. It was absolutely pitch black that night. You actually had to keep your hand on the shoulder of the person in front of you as you made your way along the beach. The guides were only allowed to use flashlights with red lenses. If the turtles sense any movement as they move up the beach they will turn around and go back into the sea, where they will drop their eggs, thereby losing them. Once they begin laying they sort of go into a trance and the guides will come up behind them and you can then observe them. But still only a red lens flashlight was used. Photography will be really difficult. Plus you will be in a group and everybody will want their chance to get in close, you won't have much time. Good luck though - great experience.

Looks like the 1099's are now downloadable. Though I can't figure out how they came up with the number reported. I've sent them an email saying I want a corrected 1099. We've already done our taxes. I'm not going to worry about it but they need to fix it.

I emaild Lee and this is the reply. Seems they erred last month and this month corrected it.
"Yes, the last few months the amounts paid have been different to the amounts earned. Firstly, we started withholding taxes. Secondly, last months payouts were calculated without taking into account the tax withheld from the previous month, so we overpaid you a little. This months amount balances that out.
Sorry for all the confusion. From next month your payments + taxes withheld should again align with what you earned during the month. "
I received this same message as you Photobomb. From number in transaction page I absolutely sure there's nothing overpaid last month. So there's at least one case with wrong tax withholding like Fairplay said...
With last months payout they did not deduct 10% (my rate) from me, it was far less. When I add last month and this month payments together and figure the tax - the extra they took this month adds up to the correct amount. They should have said something officially but the explanation seems correct for me. Can't speak for anyone else's situation. Sean:Lee assured me they would provide the proper documentation for next years taxes.

There is no cap that I know of. My earnings has fluctuated wildly in the last few weeks. I think it's more of a coincidence than anything else.
Normally I'd agree but with these posts beginning to wonder you'd need a lot more data to be sure though. I'm a sceptic because I think "hiding" stuff from buyers seems a very risky strategy.
100+ million images and you don't think there are images close enough to any of yours that a buyer will not buy something?

There was a time I would have laughed off SS capping sales but not so much anymore.

At least the 3rd time I've said this. FTP works just fine.
I agree the web uploader is broken. It sucks. But you either adapt and use FTP or don't upload.
I use Cyberduck - it's free and easy. FileZilla is another option.

Possibly Shutterstock has some special deals for prolific contributors that we know nothing about
I'm sure there are a lot of things SS does that we have no clue about.

Maybe ESB is / was a collaboration of multiple artists who either have split up or maybe even still working together that individually are uploading to other sites.

Hi,
Im not sure exactly what you get when purchasing an image form a microstock agency and usage terms. I found 2 of my images, the first one in particular are mine. Ive never sold for more than $2.85 from SS which doesnt seem like much money for an image being used like this. Especially for a major hotel brand.
http://www.lakecrackenback.com.au/
I have submitted a possible infringement with SS but like I say perhaps they are allowed as file size would be quite small.
Thoughts?
How can you sign up to license your images and not be sure if this is a legitimate use. You've been doing this for 4 years. Did you read the legal binding agreements between you and the agencies you signed up with? They all have their terms and conditions available on their respective sites. That's exactly how you can expect your images to be used. Legal use under subscription license. Certainly no infringement there. Here's the link to the licensing agreement on SS. https://www.shutterstock.com/license

Just heard back from their lawyer and they have removed the portfolio.

Read the pink bar: 'Please search for a valid contributor.'
This is an old thread and the issue was resolved -the removed his portfolio.

After finding several of my images I contacted them but also noticed on their web site they list the name and address for their Lawyer (on the page marked Legal - https://www.colourbox.com/imprint ) Her name is: Christina Wiesner Partner, lawyer Aumento Advokatfirma Ny stergade 3 1101 Kbenhavn K Denmark Mob.: +45 20 20 63 25 Tel.: +45 70 25 57 70 Fax: +45 70 25 57 71 www.aumento.dk k I figure bombarding her with emails regarding Colorboxes reluctance to remove images is fair game - it is after all a legal matter.

From the IRS web site:
Specific Instructions File Form 1099-MISC, Miscellaneous Income, for each person to whom you have paid during the year: At least $10 in royalties (see the instructions for box 2) or broker payments in lieu of dividends or tax-exempt interest At least $600 in: 1. Rents (box 1);

5. Medical and health care payments (box 6);
And we are supposed to have it by Jan 31st. They are late and always have been.

Export the .txt file from ESP, go to https://www.todayis20.com/, register and upload it... and prepare to be amazed!
Well, OK, maybe not too amazed, but it's pretty good. Try it.
Thanks for that link - makes things much easier
