Really, after a fight and a lot of of work it was accepted. Sorry Thats embarrassing and you should not have to do this!!!!. You give in or give up and go whoHoo. you help no One.I don't get many rejections But I totally support those who do that deserve better along with quality critiques and reviews. And, I will go the other way also to support SS when necessary when rejections are warranted. But, it seems plain and simple after looking at hundreds of Images people send me and Posts that there is an Issue they are simply Ignoring and......IT WILL come back and bite them if it hasen't already.

What is embarrassing? I dont understand you.

There was 2 email and 2 support contact forms filled and it took about half and hour or maybe an hour plus 15 minutes to resubmit (copy/paste old description and keywords), I see you all talking like I was going on a plane from europe to NY headquarters to sort this out or something like that.

I do agree with you that it's unnecessary but it happens.

I DO AGREE that if agency what to be(or at least look like) professional reviewers MUST know what is trademarked and what is not. It's their business to teach them, not ours, but after I contacted support (second time) they apologies and said what they said (I'm not going to paste everything here and I believe it is forbidden anyway so...)

What is good thing here and you don't see it, if we think that something is wrongly rejected (I am only talking about trademark rejection, other are too subjective) we should contact support and tell them that. We could still get note for reviewer field, that's big plus to me, without that, it could be big mess.

If I helped that reviewer to check more carefully trademark before rejection I done great job. Not just sitting here and talking about how everything is bad, sad and wrong everywhere.

I admire the amount of time and energy you put into this. I have stopped resubmitting to SS, either they take it or some other agency will sell it...

Good to hear they finally resolved the situation, but it again shows how important it is to add a small note field somewhere.

If this was one image or if those images were rejected for the same reason anywhere else I would not do anything about it.

And probably if this was on some other agency I would't do it, but SS is my best earning site so... I hope it will pay of someday :)

Glad you've got a new reply from them - still, one shouldn't NEED to fight for things like that! In your case the rejection reason was complete nonsense, it shouldn't have happened in the first place. My time should be spent on creating new images not on having to fight to resolve the problem that isn't mine - it's the agency's responsibility to control the quality of their reviews.

I got new reply from Shutterstock that gives me hope!

I knew they can be professional as they were before, they apologies for double incorrect rejection and gave me case number for those images to resubmit.

Even it takes some time to "fight", it is worth it.

You are completely right Elena and also to PixelBytes, it is very possible that this thread had something to do with that.

I agree that our job is to create images, not to fight with reviewers but it is also nice to see that we can be heard if we need to be, even if this is small example. My only hope is because of things like that, it would be nice to give us all back note for reviewer if we have admin case number. Just blank field for number, so no more spamming "thank you, you are nice person" messages. I will be very glad if topics like this one can lead to that.

I don't ask for anything more or less.

Btw. images are not approved yet, just got positive reply that I can resubmit them again and this time with case number.

Istock that has much strict trademark rejections accepted all of them.

Conflict of interest doesn't sound good or even legal...

I remember, not so long time ago, when I submitted some train photo, reviewer wrote to me (in rejection field) that I need to delete some numbers and I did that, resubmit and it was accepted. Now reviewers don't write any explanation, we can't note them admin case ref, and we all depends of their mood, incompetence or even interest.

It is not only one shot, I have about 30 or 40 shots with same model in same clothes and those are already starting to sell on other sites.

I know it's frustrating dealing with the idiotic review system at SS, (and I'm not trying to invalidate your complaint in any way) but you could just change the color of the shoes in Photoshop and resubmit. If it's anything other than red, you'll be fine.

If the shot is more important than the shoes, just work around the challenged reviews if you want to get it for sale there.

I can do it but I really would like to have some things cleared. Why so many contributors can have images of red shoes (some of them have even red soles) but me or someone else cant have red shoes even without red soles and not only that, but shoes are not main subject in photo (full body portraits). and there are images selling at shutterstock where only legs and shoes can be seen so we can say that those are main subject in the image.

I'm not asking too much... I hope.

If we contributors need to make progress in quality, we need to expect same with reviewers and support, or at least constant quality not declining in quality over time.

It is hard to accept some rejections. I try to just keep going. When you factor your total image earnings for that batch against the damage to your health and creativity it really isn't worth it. My wife always tells me just keep shooting.... Good Luck! BTW, it is a great shot!


thanks but it is just a crop, photo is full body length portrait and shoes are not important at all.

I keep going, already submitting other photos, (btw those photos were accepted to all other agencies) but I am not okey with double standards. And you quoted the Ticket reference number when you resubmitted?

their photo review system is beyond me. they are such a big agency, it has to be possible to improve the upload experience. a note for the reviewer box is really useful, dont understand why it was killed.

I understand there were probably many spam messages like "thank you" etc, but they should leave field to put admin ref number or something like that.

This way is getting less and less professional

Irritating - but you can actually email support and explain...get a ticket.
It has worked for me on occasions.

Oh, sorry,  and that is the worst part-

I contacted them, they told me all is okay so I can resubmit and I did that, and because we dont have option "note to reviewer" where we can write "Attn reviewer: see an admin about this batch case" reviewer can't see it anymore (I only checked what I can, that contest is resubmitted) so it was again rejected.

After my second rejection I contacted support again and they told me it was about red soles... even there is no red soles.

Christian Louboutin trademark is about red soles and it is not applicable if the shoe itself is in the same (red) color.

So, completely red shoes with red soles are fine and Shutterstock is selling hundreds of those.

But... even if this all is not correct please try to understand that what you see is not red sole (crop for my rejected image because of trademark) image attached:

What is more "beating me up" is trademark rejection I had, I contacted them, they told me that all is good and to resubmit with note to reviewer, I did that but it seems that they can not agree because today I got same rejection.

Something is not right there.

they should never remove writing note like it was before something like "ATTN REVIEWER: See an Admin about this batch... " because this doesn't look serious at all and doing damage to our income without any reason.

They have potential to be good but it is still not a serious place for selling images. They need to have some guaranteed briefs like 99design have or something like that.

How many days it takes usually for SS to reply on my complain send because of rejection?

I had 3 photos of my model isolated on white rejected for intellectual property.

Is that site which were selling shutterstock for example 10 images for 10 dollars then gig owner had subscriptions, download and don't use but resell them to buyer?

With all this in mind, I can't wait for the first homosexual man or woman to object to having his photographs used to promote a heterosexual event, club, or ad. Now that will be interesting to see how misrepresentation laws are going to tackle it.

I would be the first one to support him/her if my homosexual model male or female got used in adult entertainment clubs/parties with ads like "sexy bitches".

I respect my models.

Glad it's been sorted to your satisfaction. Certainly I'd hate models to be used as gogo shower girls or suchlike.

They didn't took refund at least for now.

I had two main problems here... my english and the fact that I didn't know if or where they bought the photo (because they didn't answered my mails). Only Dreamstime and iStock had sexual connotation usage mentioned in the terms of use, on first it is not allowed and second one need text about illustrative purposes.

When they told me they used Fotolia  to buy image I could read specifically their terms of use and there is paragraph

III.        ads for adult entertainment clubs or similar venues, including escort or similar services;

I knew this wasn't pure pornography, dating service or escort but when I saw on their page terms like "creamy party", "sexy bitches party" "go-go shower" etc.

They agreed to remove that photo from all their sites and I friendly advised them no to use any other microstock photos for such events. The problem remains because I have information from friend (my gay friends who were attending the event) that they were using my photo on printed banner in the city in which was that event but of course they said nothing about it (not confirmed nor denied).

So now I am with contact with Fotolia legal team but I will not talk about this in public until all is finished.

I do understand some contributors here who "attacked" me because even I didn't know about adult entertainment restriction, but it was logical to me.

My experience so far: SS legal team (I contacted when I didn't know in what agency they bought the photo) was fastest to respond with best advises and I thank them for it.

Now we will see with Fotolia legal team if image is used as printed banner and what we can do about that.

You really need to be careful going after people like you did, as it turns out you were completely misjudging the situation.

If I were you I would stop working with that model and in the future research properly before going after buyers.

From the start I knew this isn't only about false orientation but didn't want to put everything public. I was the one who wanted this solved more then anyone else, as well if any of my female models got in banner for Go go shower party girls and similar I will do the same.

They in some way confirmed that didn't read terms of conditions and asked me for opinion.

I am not a money grabber or anything, on the site they bought the picture they can be refunded and after our conversation there will be no legal actions.

After I searched their site it looks like adult entertainment club parties site, it's not site about homosexual rights and equality I was assuming first. That usage would be legal on agency they bought the image.

So, I was wrong in some way, but I friendly advised them not to use microstock images when putting text like "Sexy bitches" "go-go party" because it could lead them into a legal trouble.

On site where the image was downloaded that usage isn't allowed.

My situation have been solved for now. Thanks everyone with constructive comments :)

Looks like they didn't even bought the picture.

After not responding to my several emails/contact forms for several days with any evidence that they bought the photo I treated the case as stolen photo and image is removed. If they however show me that image is bought (or responded anything) I would check if usage was acceptably with that agency terms of use it and act accordingly.
I would be very careful doing things like that, didn't SS just update their terms?
"In the event that you believe Content has been misused, you shall take no action without providing notice of such misuse to Shutterstock and receiving Shutterstock's prior written consent to such action.
While Shutterstock takes commercially reasonable steps to ensure that the rights of its Contributors are not violated by customers or other parties, Shutterstock has no obligation to pursue legal action against any alleged infringer of any of your rights in and to any Content."

Seems like you risk violating the terms of your agreement by doing this which could possibly result in your account being closed.

I did contact SS but it looks like that has nothing with them. They finally answered my emails and we are communicating now.

I am in contact with them and we are friendly communicating about that (real problem doesn't have anything with orientation, but connotation with adult entertainment, because they are using terms like "sexy bitches" "go-go parties", ).
