Sorry, forgot that you said she was dementing.
I have an 80 year old mother who's still in top-shape, but she's camera-shy and would NEVER model for me.
And I don't think I could find myself an realistic life-size old-lady-doll on Ebay WITH property release  ;D

You're absolutely right if only one image is at stake, but the image I'm talking about is just the first one of a series of about 35 of one shoot.  And the shoot cost me about 650 dollars (doll included).  So I'm prepared to do 3 hours extra work to make all reviewers happy.

OK, I wrote to the Ebay seller who sold me the doll.  I checked her sales text, and she's not REALLY saying she made it herself, so I just hope she did. 

I think we are somewhere between art and craft here.  The doll is a factory product that is supplied in pieces.  It is a kind of new hobby for gifted women to apply special paints to the face, sew a body, attach the limbs, implant hair and eyelashes and if you're good at it, the result is very real.  If this is art, then the creator/painter needs to sign a property release I suppose?  If not, then the owner should sign the release (which is me!).

If you all think this is art, and the Ebay seller sends me an answer that she did NOT paint the doll's face herself ... what next?    :-\

Delete the image on FT ?  Why, I did not send in a fake Model Release, I just asked what would happen if I did.  The note to editor I wrote was honest and correct, telling it was a handmade doll.   
As for the fact that it could be made after a real baby, well - I know who made the doll, so what if I contacted this person and asked for a Property Release?

Now this is a new problem for me :  I shot a few photos of a young woman holding a baby.  Only, the baby is a doll, a REALLY beautiful one, and it looks like a real baby.  It is so real, that any one would believe it is a real mother and baby portrait.

Knowing I would be in trouble with Model Releases, I wrote a "note to editor" while submitting the first image, explaining why I am only adding 1 model release.  
The result ?   6 out of 7 agencies already rejected it for missing MR.  Fotolia accepted it without a problem, so they apparently are the only ones that read my note.

Of course I can resubmit, but if I have to submit and resubmit every picture of that photo-shoot, I'll be quite irritated in the end.  So I thought :  what if I made a fake Model Release, pretending I'm the mother?  Who's going to sue me?   Would I be doing anything illegal that would get me into trouble with the agencies?

So nice to have something to celebrate in this long "dead calm" summer!  For me the celebration may be short lived after I have a chance to do my end-of-month stats...

Good thing my promised no-complaints week is about up ;D

At first I also thought "wow, let's celebrate", but then I realised that Istockphoto is not selling my 2010 uploads at all ...  Lisafx already pointed this out one or two months ago.  Last week I calculated the percentages :  my overall sales for this year have not gone down, but my 2010 uploads at Istock only represent 6% of my Istock sales!

6% ??!!   I did not upload less (not in quantity, and certainly not in quality), so I can only conclude they just drowned in the masses.
Older photos are still doing well, so I'm just getting the feeling "what am I uploading for?"

The first (new) bug has already arrived :  I cannot choose any categories after uploading through isyndica, so now I have food pictures in the inspection queue with "sports" as a categorie  ;D
The istock forum has been complaining about it for two days now - guess it's just a start of a whole series of small (and big) bugs ...

Not a bad idea at all, since we all know that the only thing any site will do in a situation like this is close down the infringer's account, without compensation for the one who reported it.   A settlement between the copyright holder and the infringer + removal of all images involved would be a much better solution for every party (even for Istock!).

April was down a lot compared to March (as usual, March is always my top month), and equal to last year's April.  BUT if I compare with last April minus StockXpert, I went 7% up - so I am not worrying about the big sites, just sorry about the StockXpert loss.

To opt out of Thinkstock :  Control Panel (top right) => Contributor (bottom left)
=> Partner Program => click "Remove All" button.

OK, I'm in, just opted out for all images on both sites.
Not sure if this opting out is a great success though :  a search on "animal" gave 222000 results on Istock and 292000 on Thinkstock.  On the other hand :  images will only be removed 10 days after opting out, so may-be they're far behind removing files  ;D

What I don't understand is the "transfer" of images to ThinkStock.  Most of us have many more images on StockXpert than on IS (in my case it's 3100/1800), and the StockXpert announcement talked about the Hemera collection of StockXpert images to ThinkStock.
I was opted in on StockXpert and IS and haven't changed anything (yet), but only 300 IS pictures are appearing on ThinkStock, and not even my bestsellers.  If I click "hemera", the result is zero.
Why aren't they using the StockXpert collection?  The number is not growing, so it's not a question of slow transfer.  And why only 300 IS photos without the bestsellers?  Any thoughts?

You could ask the guy than runs marquisemodels.eu. He's a friend and he told me they were insured for that. But he's not in the least interested in microstock when he saw what it pays. They're doing assignments exclusively and their models are 2-300 euro/day.


Thanks for the tip.  I'll contact that agency.  If I tell them I got their website as a tip by FD-amateur, will they know who you are?  (if not, could you send me your real name?).

My Belgian liability insurance also covers problems during a shoot : I explicitly went for 2 policies :  one for personal stupidities (knocking over a crystal vase in a museum), and one for professional accidents (a model trips over a cable in my studio). 
I'm not worried about these accidents :  I only work with Belgian models - they don't sue so fast as in the US.
Copyright infringement is another thing, and I haven't found a solution yet.

I only have insurance for liability cases during shoots, but not for copyright infringement problems.  Why?  Simply because I cannot find such a policy here in Belgium (and neither can my insurance broker).  It does exist for other professions, like architects, but not for photographers.
I have been seriously thinking about taking a foreign insurance, but what in case of a "legal case" if you live in Belgium, have a UK policy, and a USA company sues you for copyright infringement ???

I just got an e-mail that BigStock deleted my photo, only 3 hours after my request.  Thank you BigStock for not sticking to the rules and forcing me to wait 3 months!

As for Dreamstime :  I just started disabling the SR-EL licenses there, but then I changed my mind :  instead, I'm putting VERY high prices on my best sellers (like 3000 to 4000 dollars).  If there's any one crazy enough to be willing to pay amounts like that for a single file, I'm not going to stop them  ;D

Well, the way the DT e-mail is written, means that they suppose the image is on other sites and can be deleted.
This morning, I deleted it on all sites, without a problem.  For Rodeo and Bigstock I sent a delete-request.  I know they can take longer than 72 hours to delete the file, but one look at the photo (see below) will tell you there's not much chance it will sell in the first 3 months to come :  it's a VERY typical November/Halloween image.

Still, I don't like the fact that this could happen to my bestseller(s), so I will be disabling the SR-EL for my top-50 sellers.

My first reaction was WOW!!  Great!!
I consider this photo of one of my best of a particular shoot, but it is definitely not a bestseller.  The sale was for 300 $, so 150 $ for me.  Nice.

Then I thought :  what if they did this to one of my REAL bestsellers???  Can Dreamstime just tell me to take it off all other sites? 
In that case, shouldn't we disable the possibility of SR-EL sales for all of our bestsellers?

- 30% growth of uploads, 20% growth of income (or more)
- get my boss to say YES to my request for a part-time job
- be more creative with lighting, especially on location
- have a GREAT photography holiday in France, and may-be another one in Greece
- be proved right in my dispute with Belgian social security (with regard to selling photos) without legal steps
- do less boring shoots, and more fun and creative stuff.
- at the end of 2010 :  buy the perfect photoshop-computer.
