I had been in a similar situation before where a guy on FLICKER stole my image.

The moment I found out, I replied in the comment area asking him to take off the photo, he never did. Therefore, I sent an email and a letter to Yahoo.com and they never responded. My image is still under his name. I dont think there is much you can do unfortunately unless you have some sort of copyright and that you can legally ask him to take it off.

Hmmm, thats odd. Beginning of this year, I caught a user off a social site I was using, Photography-Network, steal about 20 of my photos and numerous photos from other users and post them on flicker.

I posted comments in each of tthe photos calling him a thief and placed links to my photos, wrote my site whick deleted his accout. THan I files a complaint on Flickr, there was a link available for copyright issues leading to thier legal dept. and gave them all the links to prove it. THe images were removed.

THan I followed up where he lived and posted .

II have since found him on flickr again, but, he is keeping it clean.

I was just readin thier Terms & Conditions.

"8.2 The contract between Clipdealer and the Author is concluded for an indefinite period of time. Either party may terminate the contract with regard to the entire content or with regard to individual pieces of content, upon 6 months' notice with effect as of the end of a month. The Author may only terminate the membership in connection with the Authors' Licence Contract."

Article 8.2. Just to make sure, is this meaning that I would have to give 6 monthes notice before I could remove photos, should I wish?

thanks for the info you shared. You did a great job tracking down this questionable linkage. I heard enough to wait long before I upload anything there.

On the other hand. Regardless of who these DepositAnything guys are this is rude how you talk about the "Ruskies". Not that I am one of them it just shocks my ear.

"Ruskies" is used in a derogatory way by Americans and can be used in a neutral way by other countries. I am not defending depositphotos, but it does strike me as strange that people here give a lot of slack to picturenation even though they basically shut down overnight with everyone's images and don't provide any info on what happened, while at the same time assuming the worst about depositfiles without any concrete evidence. Is that because picturenation is British and "more trustworthy", while depositfiles is Eastern European? Do I smell a bit of racism and prejudice here . . . .

Not to mention Albumo, which was in California. Upped and disappeared with no explanation and members screaming for their money, not being paid.

Crestock either not paying their artists or very slow. Ignoring emails from contributors. If I recall, they are Scandanavian.

Imagevortex having a registered address in a pharmacy in the Vancouver region of British COlumbia.  Ignoring emails for monthes. Not returning calls either.

I think this whole thing now is appalling and has turned into an inquisition.

BTW, I am also a new member, having only been here for about 2 or 3 monthes, so I guess my comments will amount to nothing per some members here...

Is there a minimum size limit at StockXpert? I just uploaded a few pictures, and while categorizing them they were already accepted. ALL 25 of them in one batch and within just an hour or so! Last time they took over 2 weeks and accepted maybe 65% or so
The strange thing is that for one photo I made a mistake and uploaded a 800x533 photo.... and they accepted it...  ???
Is that normal?

That was a quick review, congrats. As Seb wrote in one of his forums there, they are quite saturated and concentrating on Xmas stock more than anything else.

As for size, cannot explain, but, I am sure you know, reviewers can make mistakes too.

To qualify my statement...I should add without permission from the Thunderbirds. No, I don't think it's a 1st amendment violation, any more so than not being able to photograph and sell commercially half of the buildings in New York, etc. etc. Personally, I think it's all kind of bogus, but whatever. One can take all the photos they want (I sure did when I went to the last airshow), but I cannot sell them commercially without a release. I was also told that they cannot be used for editorial, without a release.

Maybe I was not clear in the point I was bringing in terms of editorial and press. ie: television crews and press photographers for news papers. If an event happens, I am sure the press are going to cover it in terms of the so-called newsworthiness. I don't think they are going to run to the Pentagon or National Defense for a release.

Otherwise, it will get to a point that any newsworthy event would require a release. No???

I know, for instance, that photos of the Thunderbirds (air force flying team) are not allowed to be sold under any circumstances, editorial or not, so a similar rule might apply to rock concerts.

I'm not exactly sure who you should contact to find out for certain. I suppose their agent, but then you know what the answer will be there. Everything is copyrighted nowadays and needs a release. Sorry to be negative but that's just about the truth.

cidepix: We found that problem with EL prices is on Fotolia side (import from Fotolia), it should be corrected next week. I'll look at point two... it could be the same problem as with prices. Thanks.

madelaide: Yes, it was a mistake on Pixmac's side. Anyway we'll do the big check-up of our big database ;) So I think, that everything should be clear soon.

I think that by willingly giving in to unjustified suspicion and allowing an officer to inspect your ID simply because you have a camera is far more damaging to the future relations between police and photographers. Exercising your rights in the situation would be the better course of action, instead of giving the police officer the idea that it is ok to harass other photographers in the future.

And exactly what "situation" should photographers be respectful of? The fact that they have a camera in a public space? When did that become grounds for suspicion of a terrorist activity? Oh, right 9/11, the terror attack that would have clearly been thwarted by simply preventing photography of the World Trade Center. ::)

Photography isn't a suspicious activity unless you allow it to be. I'm not sure how it got to be that carrying a camera into a subway is one of the most suspicious things you can do, just short of actually carrying a bomb or weapon into a subway.

Not at all, it's not damaging to converse with the officer and offering id's and explaining what you do.

It's diffusing a situation and building a sense of trust and cooperation. More times than not, the officers wil continue on their beat and leave you be.

Remember, this photographer had a hidden camera, which, I doubt he takes with him every time he does a shoot. So, my belief was more the fact he was out for provokation and confrontation.

If you are polite and agreable with people, than, more than likely, they will be polite and agreable with you.

Thus, less agravation and you're able to continue on with your shoot.

Prices are updated from Fotolia API, we're finding the problem and we'll correct prices ASAP... every photographer got money from Fotolia's prices, not from Pixmac's prices, so you cannot be worried about it...

Personally, I think the photographer should have explained what he was shooting. In acting evasive, he obvously arouses suspicion.

I have done soots in sensitive ares, metro, airports, hydro facilites. On most occasions, I am approached by a security officer, which is normal.

I answer their questions and even offer my id's.  I have never been detained, nor, ejected from a place.

This photographer was obviously looking to cause a problem by refusing to respect the situation more than anything else and it does not help other photographers in the future.

Maybe some did, but, reading comments from their site from May to September, a lot of artists were screaming for their money, not getting any replies.

Numerous artists were demanding portfolios and accounts be closed.

I came across them in June and uploaded some files to try them out. They stayed pending right thru to their closure in October.

I was after that, reading , I saw they had serious problems.

Personally, I am going to wait a while before I upload to any new sites. Give them the chance to prove themselves.  Listen to output from other artists participating, etc.

There's another question to ask.

Figure at .50 they keep per image, cost of operation, lines, servers, isp, bandwidth, and dare I say, someone might want to make a profit somewhere.

Will they survive with the overhead.

Too many microstock sites trying to start up and try to get a piece of the action. Personally, I think there should be less.

I would think you may want to check out other anomolies on your site. Like photos from Fotolio being credited to wrong photographers.

I just made some comments in another thread regarding FT. They seem more appropriate here, so I will copy them, below.

I find FT very frustrating, as they are a relatively decent seller (typically they swap  with DT for the #3 and #4 spots in my monthly revenue chart).

Pros: Decent earnings, fast reviews
Cons: Inconsistent reviews, poor commission rates on largest files, can't edit images once submitted, cumbersome UL process (keyword order, no phrases, categories)

But no one can really answer this question better than yourself. Try them and see; the only cost is your time.

I seriously wonder, given the large differences in experiences that people have with FT, whether some accounts are marked as "pass", and others "fail".

I just ran a small test over the last 10 days. I submitted the same 5 photos to all the top agencies. Here were the results:

123: 4 of 5 accepted
BigStock: 5 of 5 accepted
DT: 5 of 5 accepted
FT: 0 of 5 accepted
IS: 5 of 5 accepted
SS: 5 of 5 accepted
StockXpert: 5 of 5 accepted

For 123, the one rejection was "lighting/composition".

For FT, all 5 rejections were for "quality of photo".

It's been my experience, and thus my question for FT, that there is a disconnect between FT reviewers and the rest of the stock sites. My acceptance ratio is 80%-95% on all other sites, but is well below 50% on FT. Are FT's standards so much greater than all the other sites? I don't think so, since I'm sure if I re-submitted those 5 images enough times (which I definitely will not bother doing), eventually they would all get accepted.

So my question, re-phrased, is that something in the review process is broken at FT, and are they going to fix it or not?


I have a similar problem with FT.

At times, I sit here thinking screw it. Are they worth the trouble.

Of the big 6, they are my second lowest.

My acceptance ratio there is about 25%.

Thank god for SS, sales this month have already doubled for me.. BME  ;D

While happy with the Big 6, I have seen more trouble than anything else with sites like Albumo, Calalog Images, Scanstockphoto and Pixmac.

  Worst  place  to  send  photos.  I  had  1  accepted.  All  the  rest  rejected  (even  some  i  have  sold  elsewhere.)  They  cancelled  my  account  and  i  acted  very  childess.  I  told  them  they  wouldn't  know  a  good  photo  if  it  bit  them  in  the  @##.  (exactly  how  i  told  them).

Funny indeed. Reminds me of Crestock this last summer.

I sent them 10 images, i believe for review. 1st time there.

They send me a note rejecting the 10 images and advising me my account was terminated with no explanation. For the life of me, I never knew why but my account was blocked.

Funniest part, the images the rejected are some of my best sellers on other sites.
