iStockPhoto.com / Re: Who puts my image on Google Maps?
« on: July 31, 2018, 00:34 »
Giant previews and tiny corner watermarks are a downside to uploading there.
I agree, but if you look at big name artists or art photographers, their sites usually don't feature watermarked images, and their pics are normally pretty big.

And many times I find their work stolen and on a Kindle book cover, their tiny watermarks hidden by Photoshop.

A romance illustrator named Jon Paul Ferrara is dealing with this right now. He had to publicly shame the infringing author on Facebook because she wouldn't answer his emails.

Just noting that depositphotos explicitly allows logo use as long as the logo is not a registered trade or service mark.

General Stock Discussion / Re: Who takes PNGs?

Resurrecting to add that Pond5 also takes PNG. They want transparency only, or else submit as JPEG.

Amazon is introducing moving book covers for Kindle ebooks. It's too early to tell whether this will take off, but it is something you video folks should keep an eye on.

Kindle In Motion

This book can be read on any device, including Kindle E-readers. Kindle in Motion books include art, animation, or video features that can be viewed on certain Fire tablets and the free Kindle app for iOS and Android.

One thing I already knew was a problem is FineArtAmerica. I have probably hundreds of images with their watermark being used on personal Twitter accounts, Facebook, blogs, couple's wedding websites, and on and on. And then there's all of the commercial sites where images are cropped right where the FAA watermark should be.

I've seen this in the Amazon Kindle ebook store. To be fair, many of the infringing "books" aren't books at all, but scams designed to get money out of the very flawed Kindle Unlimited book subscription service.

See the FAA watermark? It's useless. Poor Lee Avison's images are being stolen right and left.

Pond5 / Re: Pond 5 review changes

I got most of my last uploads accepted, but the notice with some of the rejections was interesting.
"At this point, the clips with this topic that have a greater chance of acceptance on the site are both unusual and high-quality. The best way to tell whether or not your clip has a good chance of getting rejected would be to do a search on our site for what you're thinking of creating before you put in the time to make it, and see how many results come up. If it's something that has 100+ very similar results, then chances are we're not currently looking for more unless they're something we haven't seen before or something that will make us say "wow"."

On one hand I can see how more than 100 clips of a subject wouldn't be of much use to them. But most topics do need to be updated to stay fresh and up to date. Also this means that they wouldn't be accepting anything that isn't a niche.

What a strange rejection reason...

I didn't upload 100 files of the same subject, it was from 3 different shoots, and one was travel oriented, so very few "similar" were uploaded.

They're not talking about 100 uploaded files that are too similar to each other. They mean that they already have lots of files of a similar topic and don't want more unless they're unusual or exceptional.

Why don't they just handle things like Dreamstime? What's the point of requiring 10 images now?

Adobe Stock / Re: Adobe changes at Fotolia

Every so often I search Twitter and Google to find any developments.

Today, I found a month-old job listing.

Adobe recently listed more new Fotolia jobs. Makes me think the creative cloud integration is still a few months away.

I'm sorry, what is that about "digital templates"?

Maybe the person making the email messed up. Digital templates are still ELs according to SS's latest (3/30) terms.

How will the VAT to EU customers be handled? Zenfolio said it doesn't know what it's going to do. Etsy said its sellers have to collect and pay the countries (the sellers are not happy).

What about FocalPool?

13
What about transparent PNGs? Are they accepted? Would they be displayed reasonably well on the site?

Ava Glass, we opened up the site couple days ago. We've been working with a small group of photographers from around the world behind closed doors, for the past year, to make sure we're building something that photographers can really benefit from. The video shows an earlier prototype, the site has improved tremendously since.

Oh, OK. How is it different?

15
I assume this is just starting up so you have no image database or sales?

This video is a year old, so they're not totally new.

Amazon will filter certain kinds of book covers from the main search results. Usually these covers have implied nudity or are simply too overt for Amazon's liking. Therefore, people put tamer pictures on erotic books in order to avoid the filter.

There are hundreds of thousands of these books out there. The authors use cheap microstock because they write 2-3 of these stories a week. This is a hungry market, but they need cheap.

The agencies should create some kind of designation that retains a low price, but eliminates the confusion of whether an image can be used on an erotic book.

I'm sure authors don't want to end up like the ones Nicole Forni is suing.

It looks like Shutterstock is one of defendants. They can afford big lawyers. Also Playboy, Amazon and Barnes and Noble...

Playboy, Barnes and Noble, Uproxx, Clearchannel, Euclid Media, and the Love Store all have been dismissed from the suit. Did they settle with the model? A recent letter from one of the Shutterstock lawyers makes me think so.

Quote
Forni has settled with and dismissed many Defendants, some of which may need to be repleaded into the case as indispensable (or potentially indispensable) parties.

The letter (which I got on PACER, so I can't link it) also says:

Quote
Forni and Shutterstock have discussed potential settlement, without reaching agreement.

What would it mean if Shutterstock just settles with Forni?

I'd try dragging the image into the text box as Ava suggests -if I had the faintest idea what that means or how to do it!

I was talking about the text box used to make a post here. You can also drag an image into a search bar. It has to be the image in the buy page with the pricing, not the page of thumbnails.

About pricing, Yay says image distributors can set the prices they want, as long as YAY approves.

The image license is Royalty Free with few limitations. No restriction on medium, size or usage. You can set your own limitations as you see fit.

Other images come up with different addresses. This one doesn't have "yaymicro," just "artarena."

Given the images currently there are about on par with most of the free sites out there, I think 99 cents is expensive :)

I have seen images there on other stock sites:

When I dragged the images into the text window, the addresses came up as "artarena.yaymicro.com"

Very interesting. Thoughts?

The Amended Complaint makes it unambiguously clear that written document that was signed by Plaintiff for Defendant Resnick (referred to in the Amended Complaint as the "Resnick Document") is NOT a contract at all because it was executed AFTER the oral agreement (as alleged in the Amended Complaint) was negotiated and completely performed.

Quote
(1) the Resnick Document is not a contract;
(2) that even if the Resnick Document was a contract,
it was procured by fraud; and
(3) even if there were no fraud, the Resnick Document
is only part or a larger oral/written agreement
between the parties to that agreement.

This is what the model's lawyer is arguing about the model release.
