To be honest,  I am not qualified to contest it atm.  I took part in those legal meetings, and I know the bullet points of what we required., but ss for the final drafting, it appeared to meet our business needs and to offer the protection we desired.  If there are terms that are simply not accepted in the industry, this was not the intent... in fact the opposite.  This, as well as the other constructive feedback is appreciated!  We will obviously not have a successful contributor program if all players do not feel like we are working together.

Ron: I believe we cannot.  Only "sites" owned or maintained by us... in effect, us.  In any case, I definitely appreciate the feedback.

CrackerClips:  We cannot force new terms on you, per section 9: "In the event that you object to the proposed amended agreement within such thirty (30) day period, then the proposed amended agreement will not apply to you."

Regarding other sites "owned or maintained" by us: currently there are none, but we plan on distributing an app for our service, which would apply.  Additionally, we may require different branding for different market segments.. eg publishers, DIY small business, etc.

Regarding changes: Typically more applicable for video, we may color correct, trim, stabilize, or whatever the editors feel is required for a clip to be the best it can be and work the best for our clients.  Some content is very applicable, and we do not want to reject it based on something easily fixed by our team.

Regarding your grant to us:  We are pretty much covering all basis as to how the content may be used in order to minimize risks to us and our client... including media that has not been invented or explicitly listed.  Obviously, our clients need to feel secure that their projects comply.

Sharpshoot:  Thanks for the feedback.  We do accept content with embedded metadata, but this is currently read during curating.  I will push for this to be read during upload, as you suggest.  I agree this is critical and confusing to the contributor as it is.  I'll also mandate that ftp is implemented.  We've discussed this quite a bit, but it seemed sites were moving away from it.  Your comments are just what we need.

Ron: We are currently accepting submissions.  Content will go live towards the end of this year when we launch.  Some content may be used by our beta partner, which would of course trigger royalty payment, but volume will be *slow* for months, and then start to ramp up with our sales.  Thanks for your interest!

Ron: We are in our beta with a major newspaper company right now... getting out the bugs and adding requested features.  I anticipate our launch to be towards the end of this year, although from my experience, things can always slip.  I therefore cannot predict how much content will be used each month.  I can predict, however, that ramp up takes a while, so patience will be required and royalties will start slow.  I'll also refer to our track record, which produced very high volume.  The good news is that we have a very experienced team and a laser focus on building market share with a disruptive technology.  I hope you'll place your confidence in us.
