The image infringement image is found (iStock exclusive plus image on Foap).. surprise surprise (found by a person on the istock FB board)

This site really does look like a court case ready to happen.  Do you really think the people in this 'commercial' shot are stock models?

The foap image seems to be gone? Was IS that much on the ball?

As far as a North American Single Malt Whisky I find there is nothing better than a 15 year Glen Breton!

Hope you have a great two weeks, and enjoy the concert! No one does it better!

Seems to me that it would be much easier to alter an electronic release if you were so minded than it would be a paper and pen release (ie. dates, names, usage, so on) for less honourable reasons.

You did read the contributor agreement when you joined Canstock didn't you?

StockXpert is temporarily down due to technical maintenance and will be available again on Monday, December 13.

WOW, looks like it will take IS staff quite a while to sort this mess out. lol

Well it looks like the first thing they need to do is get a new calender! December 13 is a Tuesday not a Monday!

Also, artists are keeping 80% of the commission and I am doing all of the site design and blogging, and handling all "street team" efforts.  If a contributor is uploading images without proper releases, they cannot be part of the project.  It's as simple as that.  Anyone who has been involved with stock photography for several years should know the rules.

Nice clean site and easy to get around! Love the concept!

One thing that has not been touched on is wheather or not we may need a model / property release for the cow in the field. Yes the photo may be taken in a public place but most dairy cows ( holsteins, black & white ) are as identifiable as any person!

So if I am understanding you correctly then you would be fine with that car manufacturer taking the image that you created of their car and using it for a national ad campaign without getting a release or providing compensation?

No, you still do not understand the principle. The car manufacturer is the "owner" of the car, I am the owner of the picture. I did not "take" his car; but now you say then he may take my property, my picture?
[/quote]

Not quite, what I'm saying is that if it is alright for you to use their car in your image then by your logic it must be alright for the manufacturer to use your image in their advertising.

^^ ???.  Im surprised you feel this way. Wouldn't you be pissed if some image thiefs stole your images and profitted off your images? You shouldnt profit from a product that not yours without specific permission from the copyright holder and if its cars were talking about, theres millions of dollars invested in that product.

Steeling my photograph is steeling the product of my work. By taking a picture of a car I am not steeling the car (I can not quite drive a away with the picture, can I?). I am actually promoting the product on their behalf. Can not compare it that way buddy.
I can accept a complaint if they feel you are miss representing their work/item by altering anything to it, but if that is the way it came from the factory, can not see way one can not take a picture of the item as I am not "steeling", "altering" or "misrepresenting" it in any manner - so if they spent millions on it, they should be proud to see million pictures of they product floating arround (its called good marketing).

Try searching for just your last name, thats how I found mine.

For this past Christmas I actually went the other way and scanned everything that I could find that my parents had for family photos 110, medium, standard 35, safety film, advantix, slides, one off prints. All told some 3000 files by the end and did up DVDs for my parents and younger sister for Christmas gifts. I had the same fear with losing all these film memories as I do with losing the digital ones, all it takes is one fire! I have reprinted a number of them on my hp for myself and side by side it can be hard to tell the difference.

That doesn't excuse bad spelling and grammar for those born, raised and educated in the US. I forgive the rest of the world, you all have made an outstanding effort to learn English.

So you forgive the British?  ;D

Or Canadian?  ;D

What about an international bank? Something like ING (was just remembering those annoying tv commericals here in Canada) Would something like work?

General Stock Discussion / Re: Attach a fake Model Release?
« on: September 25, 2009, 00:21 »
An interesting question. Although now the first thing that came to mind for myself is why do this? This is just a whole can of worms and any serious photographer micro, macro whatever couldn't possibly be this nuts, a newbie maybe this naive to think this is ok but cant really see it either. So that only leaves me thinking of one real last possibility..........stolen images! How / why else would anyone be wanting to submit images with forged releases! Really there is no way to check to see if the person in the image is the same as the release, even with a release with a copy of a government issued id!

Paranoid maybe but it makes sense!
