I'm really tired to see this kind of thief. Microstock is a hard world and we found always thiefs who just open an account and published our works.
In first hand, it's just insane that microstock don't check a portfolio before accept it, or create an algorythm for check duplicate images in their database. With a simple "google search image" is very easier to know the real copyright author name.
In the other hand, i hope they will do more than a simple ban. They had lawer and they could take action more important than a ban.
When we found a thief and we succeed in this case, two more thiefs appears ...

could you add "creativemarket" to the title of this thread? If they monitor here they might not spot this otherwise. Also could help with getting the word out about their attitude to copyright infringement.
done !!

as creativemarket do nothing, i decide to create an account on it for comment each images of Claus40 with this sentence : stolen image, original image by "...." (i put original name copyright) for alert buyer that they don't buy an original image but a stolen. What is the reaction of creativemarket ? : They removed immediatly my comments and delete my account Did they protect thief ? probably I report this thief to alamy and 123rf too : - Alamy delete his account so good news -123rf have begin the process and collect some proove, so i think, his portfolio will be delete in few day Just creative market have a really strange reaction about copyright infringment !!!! Strange way to protect artists !!

I made inquiries into this matter and i have some news: I contacted Fotolia, and apparently they use their API system, so it's the reason why we see fotolia trademark on images So they probably use Shutterstock, Depositfile ... api too Use API is their trick to look legal but like Jo Ann Snover said : it's "Total frauds" They use API for the look but not for the buying. They use the file locker "Nitroflare" (file locker is an illegal file hosts, made by pirate) for making money on our stuff. The people who have premium account can download stuff for free and the other must be buying account for download So all the money is directly inside their pocket I hope that all concern microstocks will do something because it's a new step on the theft of our work And for example here a quote of the api contract of fotolia (so they can do something) : 6. Indemnification
6.1 You will indemnify us and our subsidiaries, affiliates, officers, agents, employees, partners, and licensors from any claim, demand, loss, or damages, including reasonable attorneys fees, arising out of or related to your Works or other content that you provide to us, your use of the Services or Website, or your violation of these terms.
6.2 We have the right to control the defense of any claim, action or matter subject to indemnification by you with counsel of our own choosing. You will fully cooperate with us in the defense of any such claim, action or matter.
EDIT : Here a new proove that illegal website was made by pirate

yes,, i'm agree with the most previews comments And it's not original, a lot of flag or country already exist, so your potential sell are very low If we remove flag, country and word in color image, your portfolio is empty .... Be more creative

Hi,
Yes, upresentation or smiletemplates are illegals I already investigated the subject : They haven't license (they need commercial license for each image) They don't have partner with any microstock, they just took pictures from warezsite. There are websites making by the same user from warezsite
The text makes it sound as if they have contract designers doing the work.
Yes, but it's a pretext for say they are not directly responsable, but they made money with our work illegaly I already put down my pictures on it with DMCA.
The best way to fight these websites is to regroup all contributors stolen and hire one lawer to close these website and ask damage.
Why are they not directly responsible?
They are but if they have complaint , they said "i'm sorry, it's not our fault, it's the designer who submited the template But if we hire a lawer, they will have difficult to protect themselves behind one sentence.

Hello,
It's just an idea but we can create our own microstock self-managed. We can fix our own price and commission and it's perhaps a way to leave the other microstock One microstock create by contributors
What do you think ?
