General Stock Discussion / Upset model

One of my stock models is extremely upset, threatening legal action as he has found his photo used by a 'hair replacement' clinic and his photo has been doctored to show a receding hairline and patches of baldness. His friends have seen it and are rather amused - he on the other hand is seriously annoyed and is threatening to sue us.

Does this break a site's T&C, to use a photo in this way and to doctor the image. I am not sure which site downloaded it but I need to get some advice from you guys before I go after the hairloss company.

General Stock Discussion / Selling Portfolio

Hi Microstockers,

Due to changes in personal circumstances, my partner (business) and I are thinking of selling our stock portfolio of almost 10,000 images. How do we begin to try to put a price on this given the fluctuations in sales and revenue and lack of clear understanding on what the future might bring.

Can anyone point us in the right direction. We believe we have a strong portfolio and it does generate a good income each month.

General Stock Discussion / Model Release Question

I have a couple of questions regarding the model release. Anyone with a legal background who can answer - thanks in advance!

I have always required models under the age of 18 to have a parent present and sign the model release. However now we have a situation where a model was almost 20 but two and a half years after the shoot the mother is kicking up a fuss since she has seen an image used at a educational establishment where the woman does not attend. Her argument is that in Singapore, you must be 21 to legally sign a contract (I am still checking this out).

So where do I stand? All the model agencies require a minimum age of 18 and therefore that is what I have been using. However if it turns out that you need to be 21 before you can be a legally consenting adult in Singapore, does that mean my models have to be 21 to sign or since the MRF is legally binding under the law where the agency is (Calgary in iStock's example), do I go by the legal age in that country.

Any definitive answers would be most appreciative so I can go back to the irate mother and sort this out!

Dreamstime.com / Confusing Royalties

As I understand it, the commission at Dreamstime is still 50% and this is approximately what we should receive for each per picture sale. I understand that this fluctuates slightly depending on the credit package purchased and when it was purchased but I am confused by a sale recently.

It was a 12 credit sale for which I received $2.94. Can this be right? Thought I would ask advice here before taking it to Dreamstime support.

General Stock Discussion / Obama lookalike - acceptable keywording

Here's an interesting one...I shot a new model on Saturday from Mauritius who looks uncannily like a young Mr Obama. Would it be wrong to use "Obama" as a keyword? How about with "look-a-like"?

Would be interested to hear what you guys think.

Off Topic / Aperture 2 - Photo books

I just bought Aperture 2, primarily for the photo book function. I love the ease at which you can create books, the styles are good and easily customisable. The current update says it fixes some print quality issues with Aperture 2 so I was wondering if anyone else had used it and what the results were like. I have ordered a couple of sample books and can't wait to see them. Makes it very easy to make stock portfolios to show prospective models/clients.

Anyone else having trouble getting on to iStock today? It's been really slow last few days but now I can't get on at all. All the other sites fine but no joy on IS. Was going to spend some time doing some Lightbox links but looks like I won't be doing that now!

Albumo.com / Albumo

A few people have suggested I start uploading to Albumo and I see a lot of the photographers I really respect already have 1000 images online.

After checking out the uploading process and finding the ftp very good, I checked out the T&C (I know, wrong order!) to find that they sell full-size images for $1. How does everyone feel about this? I prefer to see my large images go for more than that - although of course I do put up with in with the subscription sites.

So is Albumo really worth the effort??

SnapVillage.com / Reviews taking longer than 1-2 days

I uploaded ten files to SnapVllage on Thursday to see how they would be received and to test the uploading process. The blog says that images will be reviewed in 1-2 days or else to email. Now it's Monday evening here so shall I email or just wait? Anyone else getting images reviewed in 1-2 days??

Off Topic / Charging for CD Cover

I recently did a photoshoot for a band I know, who have signed to Universal Japan. As it turns out, the band and the record company love the shots and want to use them for promoting the band and in particular, want to use one image for the CD cover. The aim is to sell at least 100000 units across Japan, Asia and then worldwide.

Before the shoot we didn't discuss money as I wanted to help the band out. I've known the drummer for about five years and it's great to see them progress from a band playing at school to fully-fledged rock outfit! Before the shoot I did make it clear that if the band and the record company were happy with the images then I would need to be paid, especially if it was to be used for CD cover.

My dilemma is what to charge. As it turns out, Universal have given the band money upfront and they will be paying me themselves rather than getting money direct from the record company. I will probably charge them less than the market rate but not really sure what the market rate is for this sort of licensing.

I am slightly confused about the MRF management system at DT and Achilles message on the homepage has me slightly worried.

I've shot over a hundred models I imagine and the newer forms (since the new system was introduced) are all in order. But does this message mean I have to go back and sort through 2000 images and place them into the correct MRF?

Also, what do you guys (and gals) do when you have another shoot with a model you've used before. Do you just add these images to the MRF already uploaded for that model (which seems to make sense as it groups all that model's pictures together) or do you upload a new MRF for each shoot. I use the former method but I am slightly worried about doing so even though it make sense to me.

Anyone who can shed some light (official or otherwise) on this I would be most grateful.

Here's an interesting one for you:

A few days ago I got a sitemail from someone saying that they had seen two of my images being used in a web template site. They were concerned that this wasn't allowed under normal licensing agreements and thought I should see what was going on.

I located the images in question and managed to send a query to the owner of the web template site. He replied saying the images had been downloaded from site A (I do not wish to name the site here). I replied saying that if the images had been downloaded from site A then an extended license would have been needed and from my records, those images had never been downloaded with an EL.

A reply came insisting that the images had been purchased with correct agreements and I replied that if that had been so, I would've received the correct payment, thinking that the buyer had not purchased the correct license at all.

Running out of patience, I explained what had occured in an email to Site A, hoping that they might follow this up since the buyer had admitted buying from this site in an email to me. Nothing heard from Site A as yet.

In the meantime, we exchanged a few more emails, with both of us getting more irate, with him insisting he had bought the images correctly and me insisting that I hadn't received the commission due to me. In the end, the buyer insisted he contact site A himself.

Not long after that, I find I have several EL sales, making Easter Sunday one of my best days ever on this site. So I am wondering?

Had the buyer gone back to the site to buy the ELs? OR
Did the site realise that I hadn't been paid for the ELs and credit me retrospectively.

If it's the latter (which I suspect it is), it's got me thinking....how do we really know if we have got the credits for all photos sold?

Adobe Stock / I'm going Exclusive!

Haha, I thought that would raise some eyebrows! Actually it's true, I've just uploaded five images to Fotolia and they are going to be exclusive there. I have set the max prices for sales and $1000 for exclusive buyout so we will have to see how the sales go.

I have had an amazingly busy November, with not much time to shoot or think about stock so apologies for the absence on the forum. Thanks to everyone who continues to compliment me in other threads!!

Off Topic / Any microstockers in Sydney?

I have decided to make a trip from Singapore to Sydney - will be there on November 11th and going to the U2 concert on Monday 13th before flying back on Tuesday. Would be cool to meet up with any fellow stockers on Sat or Sun. Not sure whether I will be bringing all the gear yet but I expect so, so if you want to go and shoot some of the sights of Sydney would appreciate a guide. Also, any advice on cheap but good hotels much appreciated.

Just submitted some shots to Shutterstock and see that they have announced their contest for the 1,000,000th image. The photographer who submits the lucky shot get a iPod hifi...

Better than nothing I suppose but I not really up to the standard set by IS. I tried this iPod hifi and wasn't particularly impressed by it...but a 30D, now that's worth having.

StockXpert.com / Excellent Sales at StockXpert

I joined StockXpert way back in October but never uploaded anything. Started this week and have almost 500 pics online now (I think I dodged the 50 a day upload limit for a couple of days!). I am really impressed with the review speed (sometimes before I have time to add MRFs) and have had excellent sales already: $29.00. That beats a few of the other sites so looking forward to getting the whole portfolio online soon.

it is good we have people like you, phildate, for the rest of us to try be better than :) It gives me ambition to keep at it anyhow.

Thank you - I hope I can be an inspiration to those aspiring stock photographers. I don't do this full-time although microstock has given me the opportunity of quitting the normal day job (I used to teach mathematics) to pursue photography as a career.
