As much as I like to say that there are universal links to which I can send a DMCA complaint to there's none.

Normally the people in our team would be looking for things like:
1. Terms of Use (can sometimes find emails to [email protected] here)
2. Privacy Policy
3. About Us
4. Contact Us
5. Abuse (we like this best!)
6. Complaints
7. Help

Then look through the pages for an email address or a phone number that we can call to state our case.

In the case of emails or a web form, we have a standard DMCA letter stating :
1. who we are,
2. who are we representing
3. what are we complaining about,
4. evidence that we are the copyright holder or representing the copyright holder
5. the link to the offending material/page.

For phone calls, we try to get in touch with the owner of the page and explain:
1. RF doesn't mean it's free
2. Having a watermark doesn't mean that you can use it for free
3. Editorial usage doesn't mean fair use

The offenders are usually ignorant of the fact of what can be done and what can't. Most of the time we hear "Other sites are doing this too..." well, how do you persuade someone who doesn't want to buy to buy? And the image can easily be substituted with another one from Google search.

So as you can see, there's no step by step sure fire tried and true way of doing this.

Hi all,

We do and we have. We have sent DMCAs to each of the site hosting companies, but the problem here is that they are using some syndication software that propagates, copies, retranslate the same article with the same image across many different blogs.

To give you some sense of what we're trying our best to do when you complain that XYZ site is stealing an image containing 123RF's logo:
1. we have to fire up the domain search tools,
2. scour the actual site to find out the owner's email or contact address (most of them it's in some language we are not familiar with),
3. ALMOST all the time they've registered for some private domain protection agency,
4. we try our best to discover who's behind it using IPs and cross referencing with our own databases.

Conclusion: Well, more often than not they're NOT contactable, we try to DMCA their host instead.

If the owner can be contacted, and is contactable, ... we get our AMs to contact the owner and convince them to license the image ( = more sales for you ! ) but this occurrence is rare : 1 in every 10 cases you report to us. And with that, most of our emails or calls go unanswered.

The communication and investigation process takes time but we ARE actively doing it. The same people who are on the operations team that handles your emails are the ones who are tasked to take try to them down. As the contributor base grows, we also have a huge deluge of email to answer, we hope that you will be more generous with the time and understanding that you can afford us.

For the record -- THIS IS NOT AN EASY 1 EMAIL TEMPLATE BLAST AWAY task. It takes HOURS to investigate a single case. Most agencies I perceive, would also appreciate it if the copyright owners (you) would also take the time to DMCA these offenders.

1. I find it alarming that emails that are sent to us were not addressed at all. Can you please forward me your email so that I can look into it?
2. We do not track views, we also not not have a RPI metric as well. Just number of downloads and image ID sort order and previously faved images. What else can we do to make your experience better?

Hi All,

Sorry for the silence, been trying to track down what's happening. Basically the story is this:

1. We have upgraded our storage to accommodate even more uploads
2. As part of that upgrade, we need to move your files from the old one to the new one.
3. Moving takes a long time.
4. We are moving files alphabet by alphabet to ensure that there's no universal downtime for the entire site.
5. Some of you may be affected whilst the large majority will not be.
6. Do be patient, your files are pretty large and will take a bit of time to finalize.

Thank you very much for your understanding. It's not a bug/error/problem, it's a planned maintenance.

We're moving things as fast as possible.

Hi Everyone,

Just to clarify:

1. Captcha doesn't affect sales. Our system detects if you're a contributor (with an active portfolio) then it will ask for captcha.
2. We are working on a new display for your convenience that will not load the servers as much, and you can be assured that no captcha PITA will be experienced after that. Do give us about a month to launch this new feature.
3. October sales has always been strong at 123RF. There are no indications that there is any deviation to the sales trend. We have not tinkered with the search algorithms and anything that will affect your search rankings. Please make full use of all the tools to ensure good exposure of your images.
4. I have not yet received ANY emails from any 3rd party providers of stock submission and analysis tools. If you are in touch with these folks, please ask them to write in: alex[at]123rf.com.

Hrm.. that's funny, it should only ask for the captcha ONCE.

And that's only AFTER it detects you've logged in correctly, and that you're a contributor.

Hi there everyone,

@Slovenian : Sorry - It's not that we're becoming big and wish to pull off stunts. We are aware how annoying this can be especially for those who check their earnings every hour or so, we are web users too and I cringe whenever I'm made to type in codes to prove I'm human.

I empathize with you - The fault is NOT yours. The parties at fault are the ones parsing the server in an automated manner.

We are going to develop an API for the 3rd party apps to alleviate this problem and shift the CPU load over to a dedicated server so that it doesn't impact the entire sites performance. We do not wish to encounter any downtimes or database timeouts due to earnings retrievals.

There is no deadline yet for this, so do bear with us. For those developers wishing access to the API, kindly write in to me at [email protected], we'll figure something out that works for everyone concerned.

Hi Everyone,

Thank you for you frank opinions. I know it's a bother but we had to look at the overall picture. There has been a lot of activity being done by 3rd party apps who retrieve these earnings and most of the time they do this simultaneously. This severely compromises our CPU time and leads to crashes and severe time outs.

Long story short: When the system crashes, you don't get sales.

To solve this problem, the captcha would still be there, however, we would be inviting providers of these software to talk to us and we will work out some ways to ensure that they can retrieve these statistics in a more CPU friendly manner perhaps through an API call.

If you are submitting the same image to all other micro sites including 123RF.com, your images will find its way onto inmagine.com via the valueimages line.

however, if you have something UNIQUE to offer and if you're submitting to Alamy only (premium RF prices, not micro) you may submit to Inmagine's IRIS. We do not want a clash of the same image appearing on inmagine but 2 different prices. I'm sure you understand that customers do not like to be deceived.

We've sent a C&D as well as persuaded the blog owner to try get a licensed version of the image but have received no replies.

I have since wrote a "Report alleged copyright infringement: Blogger" to Google's services. Expecting an automated reply soon.

Similar rejections have been there for ages. I reckon it could be a stray misclick by a reviewer. It's used mostly to reject images that have been mistakenly reuploaded by the contributor. Send us your UID and we'll look into it, our email : [email protected].
